    Buchanan Clark and Wells

I have also been at the receiving end of the foul abuse and bulling tactics used by this company. I was acused of Owing a debt to Orange of £131, which was settled in June 2006. I was told that I had to prove my innocence to this arrogant bunch of upstarts. I have since been in touchwith Orange, who most apologetically have promised to sort this matter out.

In these times of financial trouble, I find it discusting that these people are allowed to abuse and threaten innocent members of the public. I told them they could take me to court, I almost wish they would, I would love the opportunity to speak out about these leaches, who live on other peoples misfortunes.

Tell them to put up, or shut up. By sending a copy of the prove it letter below by recorded delivery, the onus is on them to provide the proof otherwise they have no further case.

    .....................

    Your name address & Date.

    Dear Sir/Madam

    Account / ref no.

You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

I am/we are familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

I/we look forward to your reply within 28 days.

    Yours faithfully

They follow scotish regulations which are not quite as kind as ours are. If they get too much people have to report this company to the csa and oft.

    Re: Buchanan Clark and Wells

It's really helpful to know that others are struggling with this BCW firm. I received a letter addressed to my father a month ago from them stating they had had a recent communication from him and that he owes Orange £30 (he never at any time had an account with Orange) He also died two years ago!

I wrote and explained this immediately and had no reply until a very nasty final notice letter today saying he hadn't made any contact with them since their first letter.

I've re-sent the same letter. Do I have to continue? I know Dad did not owe this money. Still grieving very much for him so could do without this. How do you stop it?

    Many thanks

    Re: Buchanan Clark and Wells

Sorry to hear of their disgusting consideration of your Father. You should also send them a very, "down to earth, to the bone" letter, explaining that your Dad is deceased and let them know your feelings how you regard the manner of their intrusion.

If at all possible send a photocopy of the death certificate as evidence. That will show they have simply been disrespectful and wasted their time, tell them any further contact about this matter will be sent onto the newspapers along with the trading standards and Office of fair trading. !

    Re: Buchanan Clark and Wells

    I hate this company...get this

We got a letter about 2 months ago saying my girlfriend owed a Barclay Card debt of £4000!!!!! Weve never had a barclay card! They state the card was opened in may last year, strange considering we moved out in April.

I told them to write back with what they found out after going back to Barclays with it. All i get is phone call after phone call. I tell them to write as my girlfriend cannot take their calls during their opening times.

They state 4 letters have been sent but we only got the original which we replied to so why would we not reply to the others. I cant help but end up swearing at them ever time they call. They wont even send a copy of the credit agreement which i thought they would have to as surely it falls under data protection that we are entitled to see.
