I think you let them off lightly by accepting £100 - goven the history you complain of above I would have been asking for more.

Glad to hear you got it sorted.
Legal advice will always be to put things in writing as that means you can properly evidence them should an issue go to Court. Whenever you do make progress by phone, be sure to take notes, date and time them, and get the full name of the person to whom you are speaking.
It's a pain, but, when the proverbial hits the fan, you'll be glad you did!!

finally sorted the case out about 2 weeks ago - got my car fixed very quickly and £100 compensation - thanks very much for your help!

Hi Nikki
It sounds as if you have had a bit of a rough time with your insurance company. Firstly who was it who has told you to lodge your complaint in writing as this is technically incorrect? They can act on your complaint over the phone just as much as you going to the time and trouble of writing a letter, this sounds to me like they were trying to stall you. I would firstly insist on speaking to someone as senior as possible at the insurer, explaining to them as full as possible what you require from them and if they dont resolve your complaint at this occasion you will then being going to the financial ombudsman whose address is:

If you go through your policy wording document that came with your insurance policy you should find the full complaints procedure at the back of this which if you adhere to and remain clear as to what you require at all times should hopefully see you get the successful resolution you want to your complaint.

Bringing action against insurance company
Wonder if you can help - I had an accident last year in October which i duly called my insurance company and lodged and had the car repaired through the approved insurers.
I received my car back and found the work was not to an satisfactory standard - some toing and froing went on between myself and the insurance until an independent engineer agreed the work needed rectification. His report was returned to the insurance company to which I was told the garage would contact me to arrange for the car to be taken in. I received no calls for a number of weeks. I rang my insurance company - was assured I would be called. Still no calls. I then received a letter stating that they had struggled to get in contact with me - turns out they hadn't amended my contact number as I'd told them - I was then told sorry we have now changed this. A number of weeks later - still no calls. I have rang and left messages with both the insurance company and the garage and they have sent me one letter (about 2 months ago) stating the difficulty in contact but I have emailed and rang about this complaint a number of times.
I just wish to know where I stand in claiming the costs for the damage of the car and compensation for the trouble and repeated phone calls, emails, etc. I have been told i need to lodge a complaint in writing to them stating they have 14 days to repair my car or i will either initiate legal proceedings/ lodge a complaint with financial ombudsman for breach of contract. I was just wondering exactly how I could push for some form of compensation and exactly what i do in the event that they do nothing in the 14 days.
By the way the insurance company is Diamond - avoid like the plague - pay the extra 20 quid to go with the next best quote and a better company!
