The car and lease agreement are your responsibility. You would have been aware of the risk when signing up to the agreement.

If you try to withdraw from the agreement, I suspect that there will be a penalty involved. This would involve giving the car back to Mercedes and settling the relevant amount. I presume this would depend on the condition of the car and the mileage. If you could not afford to pay Mercedes the relevant amount, then your credit record/rating would be affected.

The other option, if you don't trust your dad with the payments, is to make your dad set up a standard order to your account, to pay you the monthly payment say 15 days ahead of the date that Mercedes need the payment. Then for you to have the direct debit or standing order direct to Mercedes, If you dad fails to pay the amount on the given date, then you can contact him to make sure he transfers the money to you. Atleast this way, you have some control over the payments.

In regard to your dad forging a signature on a delivery notice, I am not sure about this. Are you prepared for you or Mercedes to report this to the Police and for him to face the consequences of his actions ? I am not sure what he signed and what he could be charged for. I suspect that some offence has been committed.

Betrayed by 'family' - car stuck on my name

    Hi Guys,

This is a story of betrayal and i now turn to the online community in order to do this calmly and properly before i lose my head. In brief, i took out a car for my 'dad' on my name and he was to have the direct debit payments going through his name on basis that he said he'd get the lease agreement over to his name shortly after. My fault for assuming he'd done his research but after 6 months of lies about him 'almost finalising the change of name on the lease agreement' i realised he hasnt done anything . On 2 or 3 occasions he's delayed the DD payment and Mercedes have forutnately have called to inform me. Thats had an impact on my credit rating - checked on the credit expert site.

After confronting my 'dad' about this, he is unwilling to do anything about it and is happy to continue letting the dd payments go from his account and to leave the car on my name.

Firstly i'm hacked off that he's lied, second, if he dies tomorrow, leaves the country or as he threatend , leaves the car at my house (thankfully he doesnt live near me anymore) that leaves me with car and its outstanding finance of over 29k. Again i understand it was the worst mistake i;ve made in my life so far but i was given a false story and impression. I can't go mad at the moment over fear that he might just leave the car to me and legally i cant do anything as the car is under my name.

Mercedes confirmed the name on the lease cant be changed.
Mercedes that that a part ex is possible so that he can get a car on his own name - but hes unwilling to do this.
This is a lease agreement which i signed for however upon delivery of the vehicle he used a fake signature as he had it delivered to his business address - dont know if i can use this in anyway.

Help! - what are my options?
