    BANK DEFAULT CHARGES

    dear sir ,
    I recently asked my bank for a copy my bank statments for the last years,with all my default charges.They sent me the statments
    with on default charges on them,i know for a fact that i have had 3 charges in the last 6 months.
    coluld you please advise my next move.

    Hi.

    First of all ring your bank and explain the problem. Make sure you make a note of what is said and who you speak to. This may be usefull later on. If you then get what you want fine. If not make a writen "Subject data access request", paying the fee of £10 (fixed by law). The application is under the Data Protection legislation and the Bank are obliged to send you copies of all the information they hold on you including details of default charges levied.

    The information has to be provided in readable format and there is a time limit for them to comply. I think it is 42 days from reciept of the request. If I am wrong about the timetable no doubt someone will correct me.

    Correct but it's 40 days.

    Hi stephen lawrence harrison,
    I have also asked for my overcharging correspondence from the bank, they took it upon themselves in as letter to say, that they do not owe me any money back, I preceded to tell them that this is my business to decide, if I feel they have been overcharging me on my accounts. So I am still waiting for the paperwork. Also you have to watch they do not throw you out of the bank, because this is happening, when people are retrieving what is rightly there money, the financial Ombudsman have said this is not legal, and when customers have complained to them, they have managed to get them, reinstated with there bank. Or maybe you can set up with another bank, just incase they try to do this. You also have to watch that you recieve the correct statements because a lot of these companies are sending ordinary statements deliberately at over 5.00 a time. These overcharges can be waived I have done this, on poor service,not sending my statements on time, which I rely on because I do not do online banking incase there is fraud, done against my account, They also had the audacity to change the dates I had previously asked for my statements, when sending them. My bank has made a lot of mistakes on my accounts and I am not paying for bad service.

    Firstly thanks Kirky1969 for the correct time limit. Secondly just to remake the point , under a data access request all the information which the bank holds must be provided including details of the various charges and balances.

    Hi stephen lawrence harrison,
    My six years of overcharging statements have just arrived through the post, the letters wording is so small I may need a magnifying glass to go down the columns, is this deliberate, so I cannot detect the overgharges on my accounts, maybe.
