    Iv'e heard that now once the baliff has the warrant as long as they can confirm you reside at the address they have the power to gain entry even if your not in!

    Court order required I believe. Without it, they are committing tresspass. Just don't ever open the door or have a security chain on. Have read that some without warrant will trick their way in and then once they are in, they will just say they were invited in.

    If you are leaving the country for good, perhaps MBNA will be willing to negotiate a smaller amount or force their hand to deal with your correspondence.

    Bailiff rights

    I was wondering whether a bailif has the right to show up without a court order?? As I would expect that by going to court the creditor is likely to lose.

    Also, I have been foolowing the advice on this site, and I am in similar situation to others as the lenders didn't respond to my requests for an agreement copy and yet sending threatening letters. I am wondering whether there is a way of forcing the matter to closure? I am leaving the country soon and would like to settle everything before departure.

    In my case, MBNA has offered to write off 65% but obviously that would still show the debt in my credit file and with missed payments.
