    They have to return your deposit if for any reason the sale that was dependent on a finance agreement is refused, then the whole sale collapses.

    Ask for your deposit be refunded in full, where a three way finance deal is proposed there is a creditor-supplier-debtor relationship, if this chain is broken by the creditor not accepting you... then the garage is obliged to return any deposit held.

    If you meet resistance, tell them the case will be taken up with your local trading standards department, and do so if necessary.

    Arnold Clark Finance

    As i am sure you have all read a thousand times before.

    i went into my local Arnold Clark branch to see about getting a newer car than my existing one,

    Anyway to cut a long story short i returned the next day to work everything out on my new car. I told the saleman i would be looking to get the car on finance whilst also trading my existing car in and i'd agreed to pay £100 deposit. After reading through paperwork and finding repayments etc that would suit, i then proceeded to sign the papers and he then debited my account the £100 deposit. He said he'd be in touch over the next few days once the finance had been sorted out. 2 days later he called to say the finence company had refused it and that there is a few others he can try. Though to be honest if the first one declined then i'm sure they'll all follow.

    Now for starters i really don't know why its been refused in the first palce, he mentioned that its maybe because i've never had finance before and that sometimes you have to have had finance to get finance lol............... ok but how the hell can i get it in the first place if they wont except me. I have a well paid secure job so i know thats not the problem.

    Also i'm not sure if he should of had me signing papers and paying the deposit if the finance wasn't agreed first. Now i am almost sure it will be a fight to get my deposit back.

    Any advice would be greatly apprieciated.
