Re: Are they in breach of contract

Again, never agree to anything over the phone.

Vodafone do this alot, they phone you up, offer you to halve the price of the contract in exchange for an extension, usually 6 months. They word it in a way that sounds like its a good deal, and is a bit misleading. So lesson learnt, phone sales are bad.

Re: Are they in breach of contract

Hi, from past experience the best thing for you to do here is to call vodaphone and ask them to supply you with a copy of all the computer notes they have made on your account about each call you or they have made to each other. you may have to do this as a complaint but by law they have to give you a copy. Also if you ask them to pull the tape recording of the call that was made regarding the 9 month contract you can listen to that to see what and how the contract was worded. However, whats really anoying is that they only need you to verbally say yes on the phone for you to become tied in to the contract. but regardless of that if they said they would send out a contrat then that is what they should have done. if no luck with this then and onlt then will oftel do something about it.

i have been on both sides of this situation therefore i hope this is of help to you.

Are they in breach of contract

    Here's my situation,

My contract expired but vodafone contacted me and offered me a 9 month contract at half price. I've now found out that I'm actually in a 12 month contract with 9 months half price. as my phones getting a bit tired I want to upgrade and asked if I can do that early and pay 12 months at full price (you'd think they'd be happy with that as it gives them an extra three 5 months of my custom and all my bills at full price, I get a new phone so it's win/win!). All I got is a rather useless guy on the phone reiterating that I'm not eligable til 1st January 10.

Now when the guy phoned my up and offered me the "9 month contract" I was told I would receive a copy of the contract. This has never actually appeared so would I be right in saying I've never agreed to the contract as how can I if I have never actually seen it and nor was I explained it properly?

Is this something OFTEL could help me with?
