    Hi,

You might want to have a look at this thread as it might give some insight, being similar in circumstances.

    Re: another first

Hi if you check the first page of the debt page there is a post from me just called cca you will see some of the letters i have already sent let me know what you think the oc was assosiates now citibank and Cabots say they cant give me the address of the oc to write to coments please

    P

i have sent the following today to Expedia and CCS coments please

    Experian,

    Riverleen House,

    Electric Avenue,

    Nottingham,

    NG80 1RH.

    Dear Sir/Madam,

Please find enclosed a copy of a letter I received today from CCS Debt Collection agent, I felt compelled to write to you as it seems wrong that they are misleading people in this way by making people think that your company keeps copies of their original credit card agreements.

This to me seems a bit of buck passing and may put you in a bad light I would be grateful to hear your response to this.

    Yours Faithfully.

    CCSCollect,

    797 London Road,

    Thornton Heath,

    CR7 6YY.

    Re: another first

This is a standard Cabot tactic.

If i had an ability to post here with my email address I could help properly.

The tactic to take is based on a set of letters you need to send to both

your origianl creditor and then Cabot

    Re: another first

It seems like passing the buck to me. Experian cannot give you the original credit agreement, as they do not have it, nor never have had it. I think you should photocopy this letter and send it with a covering letter to Experian, as I am sure that they would not be happy with this sort of response. Experian only have the payment information which the lenders send to them, nothing else.

    another first

    hi

I have been in dispute with Cabot finance and ccs dca who say they are acting for Cabot well another twist in the tale.

I wrote to Cabot asking for my signed cca which went into default after 12 days I then sent the follow up pointing this out and to date still no reply from Cabot. At the time of sending the second letter to Cabot I also sent one to CCS dca asking the same, for a signed copy of my cca and also a signed copy of the legal authority, the deed of assignment to collect this debt.

    so you can imagine my suprise at the reply I got today from CCS;

    Dear Sir,

With further reference to the above account, having recieved your recent letter.

We do not have the facility to obtain your credit agreement. Please contact Experian, Riverleen House, Electric Avenue, Nottingham NG80 1RH. We enclose your postal order of £1.00

    Thank you for contacting us.

The first thing I noticed is the bit about Experian thought they could only give your credit rating not your original cca and there is no mention of the signed legal authority does this smell fishy
