Re: Advice - What To Do When Seller Does Not Reply

    thanks for advice

but it was a private seller; who used the allure of a 3month guarantee to sell the vehicle. good news; her husband replied when i mentioned possibly seeking legal advice. but the guarantee taken out on the car does not cover faults (or incorrect coding) but damages and he is refusing to cover the costs because the car is drivable. I have to chalk this one down as a lesson learnt when dealing with private sellers; especially when Im having to deal with the husband of the person i bought the car from.

This is my first car and has dampened the celebration; will be dealing with traders in the future

Difficult, it is was a private sale. You would have to prove that the seller was aware of the faults and then take them to court.

It sounds to me like the seller was actually a trader, otherwise why would he mention a 3 month guarantee. Private sellers won't offer this. If you could prove that the seller was actually a dealer, then you have more rights. See the following.

Advice - What To Do When Seller Does Not Reply

I purchased a car just over a week ago; it was advertised as being in great condition; with a full MOT carried out not to long ago; with a three month guaranty from a private seller. I booked an appointment with a mechanic he discovered a few problems; problems that should have been detected by the MOT and known to the seller. I have the vehicle reg from the DVLA. My problem is; the seller is not in the country and has told me to call her husband to sort out any problems but he is not replying to any of my phone calls or letters. What legal rights do i have in this case?
