If you have comp cover your Insurers will deal with your claim and then once settled they will try to reclaim the money from the ladies Insurance company. If you have incurred any losses such as your excess, you will also need submit a claim to the ladies Insurance company. If you took the legal expenses cover, they will help with the latter.
On your policy the claim will be noted as fault, until your Insurance company have recovered the money from the other Insurers. Or if the Police report is clear that the lady is responsible, they will send the report plus your claims details to the other Insurers, at which point the other Insurers may accept fault. It is only once either your Insurance company have recovered the money or the other Insurers have accepted fault, that your own Insurance record will be noted as non-fault.
In the event that the Police report is unclear and the lady does not admit responsibility, the following should happen, but it may take awhile. The ladies Insurance company will write to her with a claims form for her to complete. They will point out that it is a condition of her policy to report all accidents to them. If the claims report comes back, her Insurance company will look at her information and compare this with your information. If according to the highway code and usual practice, it is clear the lady was at fault, they will admit this to your Insurers. If the lady does not cooperate with her Insurers and does not complete the claims form, her Insurance company will write to her advising her of the consquences. They could advise her that without her side of the story they will admit liability and this could affect her Insurance premium at renewal. This could drag on for a few months.
Please note that if your policy comes up for renewal while the claim is still noted as being a fault claim, this will affect your Insurance premium. If the claim is subsequently amended to non-fault, they will amend the premium.
