callum 2009 - 1. this is an old post
2. the store shouldn't debit the card until they are ready to despatch the item!!!
Thanks. I guess I thought as much but was just really annoyed that they had let me down after looking so long for a dress!
At the very most they may have committed a minor "availability" infringement, but if it's a simple one-off human error then trading standards would not be interested in any complaint, especially as they have offered a full refund.

I purchased a dress from a website 'Spoiled Brat'. Once the funds had been debited from my card they sent me an email to let me know that the item now sold out. Although they have offered a refund I feel it is a major failing that they advertise sold out items. Can they get away with this?
Thanks
