    There are two processes whereby you can request a copy of your agreement.

    The first is via the Consumer Credit Act 1974 s.77-79 (depending upon type of debt). This is by application to the creditors registered office, costs £1.00 and takes 12+2 days. Results can be variable or inaccurate.

    The second is via the Data Protection Act 1998 section 7 by application to the Data Controller at the creditors head office. This cost £10.00 and takes 40 days.

    In any application you should make it clear which legislation you are applying under.

    1st Credit - Old debt

    Hi. I recieved a letter from 1st credit yesterday regarding an old debt which is now £2,867,03. I have drafted a copy of the excellent letter you suggestd,but in thier letter they say-

    'In accordance with the data protection act 1998 we will comply with any request for a copy of the personal information about you that is held in our computer system.

    Send your request along with the administration fee of £10.00 and a self addressed envelope to the above address.'

    Is the £1 statutory fee you stated a standard amount? It feels as if it is maybe a trick to try to get me to make an initial payment.

    On the other hand I have moved since taking out this loan & have no idea how they got my address.After reading threads no doubt by underhand means. Would they be certain I was here or is a bluff?

    I am so glad I came to this site befor doing anything as I am unemployed due to mental health reasons & have no way to pay anything like what they are asking for (the full amount!). Any help would be greatly appreciated.
