I joined nuffield health club in june 2008 and signed up to a years contract. I completed this and in june 09 recieved an email from the manager as follows.. Your new contract will start on the 1st July 2009 and run until the 30th June 2010, you will stay at the same rate of &amp;pound;65.50 per month during this 12 months. On the 1st July 2010 unless you contact us to renew your 12 month contract or complete a cancellation form giving 1 full calendar months notice your membership will automatically change to a monthly continuous membership at &amp;pound;69.50 per month.  I decided i did want to stay at the gym but on the rate i had before, i had already done my years contract and just wanted to carry on paying and doing what i had been doing, assuming that as there were no terms and conditions attatched so i could break it when i needed to ( all gyms i have been to before once you have completed a year just do a rolling membership) as i knew at some point i would be leaving ( my partner is australian and we were either going back there or moving to another part of london) So i replied..... Please could we continue with my membership at 65.50 per month for the next year.  Anyway we decided last month to move so i emailed to cancel my membership and was refused as I am apparently tied into another for the whole year, with no get out what so ever.Our new place has a gym and a pool, and is costing more money, so i cannot continue to pay for this extra service.I called up to tell them this, but there was no reasoning, i even asked if they could freeze it so i can sort out some way of financing it, again to no avail.So i asked for my contract this morning.The only thing they had was the paper i had signed that stated the years membership from june 08 to june 09, there is no signed contract or terms with a date and signiture on for my "new contract" , just the email.I have even asked if i could find someone to take over my membership but this is not allowed either, (although I was told by their head office it was up to the manager and the manager contradicted this by saying it is not allowed with nuffield health)Im really frustrated I have been a good member,i use it regulary, no late payments, put up with no air conditioning for 4 months whilst they fixed it, my partner had his goggles stolen whilst in the pool, (they were only at the side of the pool!) and i feel they have not been helpful at all.Does anyone have any ideas? I feel that if a security camera were present it would establish how a small minority of your staff intimidate customers &amp; junior members of staff into verbally mistreating customers via the telephone. After 7 hours of ringing customer service and being humiliated I have no doubts in my mind that if a member of staff were to acknowledge and verify that my treatment was inhuman that they would only serve themselves with the punishment of losing their career&amp;rsquo;s and their future with your company.  I only rang customer service to establish if I could borrow or have replaced a blu ray system which we bought in Aug/ Sept 08 and which had only been repaired in October 09. The engineer turned up at our home in Dec 08 but due to the presents we had bought our young old son for Christmas we were unable to allow him to take the blu ray away until after Christmas. I tried to explained to the customer service dept., that after the first repair of the blu ray which was repaired in Oct 08 in our home after having had to wait about 3 weeks for the part to arrive at the repair companies depot , that I had reported the blu ray not working properly again 2 days later Oct 08 . I established that since Currys had changed over repair companies that our records were lost. I was informed that I had according to their computer, only rang customer service in mid December 08 reporting the fault. Therefore I was not eligible to a replacement blu ray.  I did not at this point realise that since we had taken out the extended warranty that we were entitled to a replacement because no engineer had arrived within 28 days of reporting a fault. I can prove that I did not ring customer service in mid Dec 08. (I am only assuming the entry on your computer must have been when someone updated our records) However I can prove the item was previously repaired and that I contacted customer support in Oct 08. However I was asked to prove that I had asked for an engineer to attend our home. I was informed that none of the previous repair history or our telephone calls reporting a further fault in the Oct 08 about the blu ray was passed onto our records from the previous repair company. My integrity was questioned.  I did speak with a staff member who&amp;rsquo;s identity I am not prepared to disclose until I have written assurances that their treatment and their job/career within the company is secured can testify that my treatment was degrading. The staff member can further evidence that my records on the computer had been lost and that a supervisor had blocked every staff member within the customer service department from using their discretion to authorise a replacement. The staff member acknowledged that since I had questioned a supervisor albeit professionally and calmly having pointed out an error of honesty that they had took an exception to me and made it their business to ensure my mistreatment.  I was ridiculed when I mentioned a disability I unfortunately have, by a supervisor who suggested I should not have rang up customer service until I was able to listen or speak sense with proof that I had reported the fault in Oct 08. I am a professional person and have never in my lifetime been treated with such disrespect. I am sure if there is justice those who I spoke too will let you know who they are by the barrage of comments they will have to say about me. If like me they tell you without oxygen (taking a breath of air) what a nightmare of a customer I was please take note of their demeanour and attitude.  I can say with total honesty that I never raised my voice nor was I rude or sarcastic nor was I at any time, unprofessional. I have contacted DFS and have arranged to have the sofa delivered to my moms address and stored in the garage for a week until I move in.  I am reluctant to take it out of the packaging until I have it at my new place; however this means I cannot inspect it for damage etc. Is there anything I can do with the delivery people to insure that if there is a problem, they won&amp;#39;t claim it was damaged when I moved it to my new house? I was told it was wear and tear,they hadn&amp;#39;t even looked at it, well to cut this short, The Range sent out a furniture upholster Homeserve, who told me he could feel the difference in the 3 seater vinyl compared to the 2 seater seater but that it would cost the range too much money to repair and the years warranty is up.  When he told me about its only the vinyl areas that have cracked , I was shocked as I thought I had bought all Leather, he said I should take it up with the Range.  He asked had I washed it I said no as it was a new room new furniture covered with throws and no food or drink aloud in the front room but I had wiped it at the most twice when I had put the throws in the wash.  His report came back with the Huggies pure like cotton wool and water had damaged the sofa.  Obviosly not happy with this I paid for Homeserve to come back, this now 5 months after first report, the upholster said what did first report say I told him it would be unfair to say he said well if you dont say I will look it up on the computer when back at the office.  Well yes his report states it&amp;#39;s the wipes, I did not wipe the whole sofa exspecially where it is cracked the only area was the top back where it gathered a bit of dust and used the left over from same wipe for the arms, as I said it was all clean as no food or drink . I am now having to arrange through Fira to visit as I beleive it is faulty vinyl and we have taken good care of it.  Is there anyone else who has had a similar problem with there sofa cracking, for the two times I used the wipes I wish I hadn&amp;#39;t but I thought if I told him I had not ever touched it he would of said that was the course.  If anyone can help me with any advise as I have now been pursuing this now for 7 months, whats so anoying is its not like the sofa is worth thousands it&amp;#39;s just &amp;pound;600, I would not of purchased this if I would of known this was to happen , I would expect a good 5 years plus from a leather sofa. Was transferred to case manager Shawn stated it couldn&amp;rsquo;t be claimed under these because 7 day rule not in contract agreed reluctantly to request write off under 21 day rule would contact when heard decision. On Wednesday 13th may 09 rang back Shawn not available advised would ring back when chased up, came back from been out late afternoon to message confirming refusal to write off. Rang Shawn back complained advised complaint was not valid, asked to speak with someone higher advised couldn&amp;rsquo;t offered another appointment held until I seeked some advice. Rang head office requested to speak with manager, was refused but insisted was advised that one may ring back, Thursday morning attempted to make complaint with same response decided to visit manager to complain, spoke to graham deputy manager Thursday 14 may 09 he contacted someone within the company I believe to be Paul as written on card by manager. Manager confirmed that item was written off and the television was to be collected that day !! Between 12.45 /5.45 went home to wait, no pick up made. Rang manger back morning of Friday 15th who chased this up as did I contacting whatever happens team who said had been cancelled, spoke back with manager who was told different and infact it was due to be picked up on Sunday 17th 09. Manager confirmed I would be contacted to be told what time on the Saturday afternoon latest and if not to contacted him back, no phone call contacted manager Saturday afternoon 16 th may 09 he then again chased matter up and was told has been booked for Sunday 24th may 09 manager managed to back to original date Sunday 17th may 09 supplied collection number for time slot to obtain 4 hour time slot. Rang morning Sunday 17 th may 09 to obtain time slot no record of slot went through to operator who said it was due to be picked up but no time given, stated had try to contact by telephone and couldn&amp;rsquo;t and would e mail with time slot. Never received call back neither did they turn up, rang back manger Monday 18th may 09 he chased matter up further and rang back he was told someone had altered it but had arranged again that it would be collected on Tuesday 19th may 09. Received phone call from tech guys stating that manger Shawn would ring to advice what was going on ten minutes later received call stating that collection had been cancelled as it couldn&amp;rsquo;t be written under 21 day rule because of gaps of over 7 days twice not in contract. Shawn supervisor /manager stated I had refused a appointment not true had already made on job no above basically made me out to be a liar. Spoke to graham deputy manger who contacted again as wasn&amp;rsquo;t happy been lied to, he contacted me back stating that he could do no more as it was out of his hands. Rang made new appointment again for 21st Thursday 09 but had got mixed up and rearranged for original date 22nd may 09 contacted consumer people who advised sale of goods 1979 . Sent e mail and also contacted regarding this with no change in position, wrote e mail advising my position and legal action if this was not rectified as advised. Tuesday 19th may 09 spoke with consumer people again who advised I should put repair on hold if I was considering taking legal action as repair may affect this after more correspondence and speaking with financial ombudsman referred to trading standards. Postponed appointment for repair as advised them was taking matter further. Delivery drivers turn up to collect TV advised that it had been cancelled and the supervisor Shawn promised this was the case as advised wouldn&amp;rsquo;t be in , offered to let them take it but refused anyway due to been on wall they left delivery advice with reference numbers on which I have as evidence. Received correspondence from director of which I will e mail to you as well. Wednesday received five phone calls answered when got back was someone acting on behalf of directors of which he put points to me of which I cannot remember all but 7 day rule was mentioned again as was the fact that I had refused to have product repaired on several occasions, manager Shawn had clarified that I had not made appointment on several occasions and also refused on several occasions reasonable access completely untrue up to Tuesday 19th may when I have cancelled appointment as already stated.   Hope this clarifys this doesn&amp;rsquo;t list every conversation or manger s I have spoken to and broken promises I have but it does have the essentials. However, I have now received an email from the seller stating that the sofa is damaged and the plastic covering ripped. If this damage is true, who is responsible for it? I lose out on traditional HD viewing but then movies is really where I reckon I&amp;#39;ll see the benefit of HD as I don&amp;#39;t like documenataries or sports. My fear of this route is the original investment cost and also the high price of even older Blu Ray films. However the advantage is that I only buy what I really want, focusing on the films I simply can&amp;#39;t do without in my collection (i.e. you can bet that the recent Batman films, both Transformer films and James Bond films will begin to feature!)
