I am currently have issues with DLC (Direct Legal & Collections). They are acting on behalf of their cilent: Orange Personal Communications Ltd. The debt itself is my mothers, in which she owes around £506.63 on the debt. She contacted DLC and they advised her that she can settle the debt in installments of 8 weeks of £63.33 a week or over 4 weeks at £126.66 and she was not happy about this as she only works part time which is an hour a week and cannot afford this amount each week. And they would not settle for a lower payment and told her she was to pay immediately and could only offer her 8 weeks to do to avoid the possibility of legal action being taken against her, and obviously incurring additional costs. She accepted the terms to this, and obviously I was not happy because she was not happy about it, so she called them back up and gave me approval to settle the debt and talk about it with them, but I could not get any further. I told them I can settle the debt with two payments, one for October 27th of £200, and one for November 24th of £306.63. They would not accept this and said I could only pay in half payments so would have to pay £253.32 on October 27th (tomorrow) and the further and final payment of £253.32 on November 24th. Having said that and agreed terms as I could not reason with them and simply gave up. And everything was going as planned but I have since picked up a snag and have had to pay another debt in the meantime which means I was unable to meet the payment terms agreed for tomorrow. I contacted them yesterday and they accpepted that I could not pay the full amount agreed for October 27th so now they've settled for £101.32 per week up until November 24th but sadly after looking at my outgoings for the next few weeks I cannot afford that myself. Also they would not accept that I could not pay on November 10th and they told me I cannot miss a payment or legal action would be taken for the amount outstanding. They even asked me to provide a Credit / Debit Card so that they can take the payment instantly every friday for the next five weeks. They would not agree to the new terms unless I did this. I have since found this site and also a Office of Fair Trading document on Debt Collection and what can be done and it says something like this under Deceptive and/or unfair methods sections. "Pressuring debtors to pay in full, in unreasonably large installments or to increase payments when they are not able to do so." So after this long post, and explanantion of this debt and dealings with the Debt Collector in question "DLC (Direct Legal & Collections)" I am wondering if I phoned them up against and questioned the fact they are going against Fair Training Standards for collection for a debt and offering payments that I am unable to afford, but they will not listen to reason. I want to pay this debt, and I wish to do so. But I cannot afford to pay what they are asking, without risking other bills and payments I need to make whilst trying to settle this debt. Its just got me so annoyed and I am basically asking for some help on what I can do to resolve this and maybe get a lower re-payment settled with this company that simply will not be reasoned with. Thank You Regards Adam Norton

Should I invest in my football club?

Now then, lovely community-ites, here's a question for you to tackle... Fellow fans of my beloved football club (Newcastle) have set up a trust and have launched an ambitious bid to buy the club from the owner, Mike Ashley. It's called the 'Yes we can' campaign and they've registered with the FSA as an Industrial and Provident Society and it has the backing of the Inland Revenue. The idea is to use the Barcelona model of ownership where the fans own the club and appoint a board with control of day-to-day operations. The press release says 'The idea is based on fans investing in the club through a number of financial opportunities which will be held by a local solicitors in an Escrow account to demonstrate to the owner that the fans have 'proof of funds'. Supporters will be asked to pledge 10% of their investment into this account which would be returned if the bid was unsuccessful'. The full press release can be read here and the Q&A here. I bought a house last year and I'm getting married next year, so finances are very, very tight at the moment, but I very much want to help and want to contribute. I think this could be a once in a lifetime opportunity to help shape my football club. But what do you think? There's a lot of expertise on here and I'd like to hear your thoughts (minus the inevitable chuckling at the back there from fans of Premier League clubs!)

CCCS vs Debt Advisory Line

I am a customer with Debt Advisory Line and have made my first payment (£170). I reserved a property at the peak of the 'property boom' in July 07. The property is due to be competed in April 2009. It was agreed at £160k and a 10% deposit paid. In the current climate it is probably worth around £120k. and this could get worse! From memory, the contracts detailed that the sale was not subject to receipt of mortgage etc.. However, it is inevitable that when the time comes the mortgage companies will not value the property at the higher levels, and we will have to hand over additional thousands of pounds to the developer as well as additional deposit to the lender! I realise that if I pull out of the sale I will lose my deposit. But could I be 'sued' or otherwise legally FORCED to purchase the property? Thanks for your assistance.

O2 and default on credit report

I have a default on my credit report and I was wondering whether it was worth putting a 'note' on my report explaining the circumstances surrounding it? The circumstances are that I feel I was harshly treated, although in the end it was my fault for not paying my bill......... I had an O2 contract which was an onloine contract i.e. you would have to log into their website to view your bill etc etc, payment being made by DD. I cancelled this at the end of the contract (back in May 2005) and thought that there was nothing outstanding. Having looked at at copy of my credit report earlier this year to my horror I see that they defaluted me in Januaru of this year for the measly sum of £8!! I contacted them, obtained my old username and password and indeed there was a balance of £8 due which I subsequently paid. When I queried why I was not chased for this amount, I got the reply that as it was a n online account it was my responsibility to check my account and they do not chase via e-mail, phone or letter. I checked my online accounts and there was one chaser in my O2 account one week after the amount fell due (May). I just feel the amount of £8 one chaser would have solved the issue, but instead I've ended up with a default against my credit report for 6 years! I never even got issued with a default notice which I thought they were required to do?? Is it worth putting a note on my report explaining this as its not a typical, I got into trouble with too much credit couldnt afford to repay etc default as apart from this I have a near perferct credit history!

elderly mother

Mother s health deteriorating , shes now 83 , worried about fact that in time she may need care and that may require her being put into nursing home or sheltered housing , my understanding being that other than some £3000 this would have to be paid for out the sale of her house and any other money she may have in savings. The sales assistant at the time told me the flats were being sold for 300k each to which I responded there was no way I could afford to buy one. She then explained to me that she could give me 15 percent off making the price just 250k avoiding the expensive stamp duty, I then carried on and insisted that I had no deposit how could I buy this flat? She then told me that the bank would value the flat at 300k on its completion and lend me up to 90 percent of this so that I would get 280k which I could give 250k to george wimpey and keep the rest. I said I would think about it after which she continued to call me every single day harassing me asking me why I wouldn't want to have 20k in my pocket for free. In the end I agreed and gave her my credit card details which she took 2500 on. Within a week she phoned me and said that if I didn't give her a further 10 percent that I would lose my 2500. At this point I told her that I never had that money and had only agreed to buy based on the fact I had no money. She said I needed to put 10 percent more down and legally exchange contracts. After she realised I didn't have the ten percent she offered me exchange bond and said don't worry this is an insurance policy so we can carry on. I filled out all of the forms, and duly exchanged not realising what I was committing to. The solicitors I used, silvers, now silvers arch did not tell me of the liabilities that could arise from this exchange bond. 6 months later Rene had left the site and I was receiving more calls from george wimpey asking me if I had a mortgage. I told them that I never had one and then they asked me about the deposit. To which I responded that I had no deposit and told them what rene had told me. To this they responded that I could not borrow that much and that they had never even sold and of the flats there for 300k in the history of the site (even though this was my contract price). They told me I had better find a deposit and fast, and that if I didn't then they would draw down on their bond and bankrupt me for their loss of income. At first I didn't understand what they were talking about and then later I felt very cheated, george wimpey had lured me by inflating their sales price 15 percent, made me formally exchange by threatening to make me lose my deposit if I didn't. Failed to explain the complexities of ebond and and if I didn't buy they would come after me for 25k and then bankrupt me. As a teacher working for very little pay, this will ruin me, george wimpey have been completely ruthless since they got the bond in their hands. Having spoken to experts on this matter they have stated that: 1) George wimpey misrepresented the sale by inflating their sales price and the rental values then discounting them to still unrealistic levels in order to lure me in as a buyer, apparently this is a tactic they regularly use. I thought I was getting 15 percent off when in reality I wasn't getting anything off, it was on this basis that I got involved. I was unable to do any due diligence because you cannot have a survey or valuation done or even get a mortgage for a flat that is almost a year away from being built so was very vulnerable. 2) George wimpey explained to me how I could buy the flat with no money because it was worth 15 percent more then I was buying it for. They now deny they said this and that it is mortgage fraud. 3) George wimpey knew full well that I could NOT complete especially as I had been very open that I had no deposit, yet still made me sign the ebond, this was so that they could conspire against the bond company and receive 10 percent of the value of their sale even if I didn't buy. George wimpey at altius has acted fraudelently in many ways: 1) By misrepresenting the sale 2) By making me take out the exchange bond, knowing full well I could not buy the flat, their intention was to defraud the exchange bond company all along by using me as a pawn. I have also contacted the fsa, as; 1) Exchange bond never advised me I could be liable for 25k in the event I didn't buy the property 2) Exchange bond never told me that the value of the property may go up or down or might now be worth what george wimpey said it was 3) Exchange bond never advised me of the fact I might not be able to finance the property or of any of the pitfalls I am now forming a lobby of innocent people who have fallen victims to this type of scam and have found george wimpey to be perpetrating this on a very large scale. Can anyone else who has been done by this scam please contact me via this thread? Can anyone out there help me?

ISAs

If i invest in a cash ISA in July 2009 with the ABBEY AND PART OF THE DEAL IS A 2% bonus do i have to leave this until July 2010 or can i reinvest in a other ISA in the new tax year IE April 2010

extremely stressed

Hi I did a UK CHAPS with the Halifax on wed 15 july and 2 days later the recipient still hasn't recieved the funds. Thanks a lot John (Post ends) Can you please advise why the "bonus rates" are not quoted? It may be that you do not include Accounts with an Introductory Bonus in your tables! Am i crazy for getting a huge loan, or is it a way round unlocking it, as when i'm 55 the loan would be paid off and would get my pension again... not sure what to do for best really

Advice on a (possibly) invalid Will

Hi, I'm hoping someone will be able to give me some quick advice on an unusual problem? My wife's grandfather has recently passed away. He had a will made in 2004, in which he made my wife (his granddaughter) the executor and beneficiary of his entire estate. At the time of signing, I signed as one of the witnesses (a close friend of the family was the outher witness). I have no gone onto marry his grandaughter. As we have started looking into obtaining probate, it has become painfully obvious that me being one of the witnesses has invalidated the Will? Would we be correct in thinking this? If this is the case, does it literally leave us in a situation where there is no Will? Our granda had two children, one is my wifes mother who has died, he also has a son who he hasn't spoken to in 20 years. Where does all this leave us? We are obviously getting a solicitor, but if anyone can give me some pointers that may help shed some light I would be very grateful.

Statute barred

Help, approx 6.5 years ago I lost the plot and started to stop paying all my credit, during this ime I have sorted myself out but are not in a postion to pay back what I took out in credit. I RECIEVE A STATEMENT EVERY MONTH SAYING WHO THEY HAVE PAID. LAST MONTH I RECIEVED A LETTER FROM ONE OF MY DEBTORS SAYING I HADN'T PAID THE £1 AS AGREED, BUT THE NEXT DAY I RECIEVED A STATEMENT FROM DEBTCALL SAYING THAT IT HAD BEEN PAID, SO I THOUGHT THAT THEY MUST HAVE RECIEVED THE PAYMENT AFTER THE LETTER WAS SENT SO LEFT IT THERE. THIS MONTH I RECIEVE A LETTER FROM THE DEBTORS SOLICITORS SAYING THEY WANT FULL PAYMENT IN 7DAYS. SO THIS TIME I THOUGHT ID PHONE DEBTCALL AND TELL THEM ABOUT THESE LETTERS. I TRIED THERE 0800 NUMBER FROM THE INTERNET, NO RINGS JUST SAYS "CALL REJECTED" AND BEEPS. SO I EMAILED THEM AND ADDED TRACKING TO THE MESSAGE, MESSAGE DELIVERED BUT NOT READ. PHONED THE DEBTORS SOLICITORS AND THEY SAID THEY RECIEVED A LETTER FROM DEBTCALL SAYING THEY WERE PAYING MY DEBTS AND THE AGREED REATE BUT NEVER PAID THEM. THEY HAVE NOT PAID MY OTHER DEBTORS. I HAVE CALLED THEM AND MOST OF THEM BUT TWO AGREE TO STICK WITH THE £1 PER MONTH PLAN, BUT 2 HAVE SAID THEY WANT AN INCOME EXPENDITURE FORM AND MORE MONEY, AND BOTH WORK ON BEHALF OF HALIFAX WHICH HAVE BEEN A NIGHTMARE WITH PROTECTION PLANS AND PAYMENT AGREEMENTS SINCE I FIRST GOT IN TOUCH WITH THEM. HAS ANYONE ELSE HAD ANY PROBLEMS, WHAT ELSE CAN I DO, WHAT IS THE BEST CALL OF ACTION? I AM REALLY WORRIED AS THOUGHT ME AND MY FAMILY WERE STARTING TO GET SOMETHING SORTED, AND NOW FEEL LIKE I HAVE BEEN RIPPED OFF AGAIN. I am sure I can retrieve this £1800 under consumer credit act from my credit card company. The tricky part is that the a balance of £55000, for part-payment was paid directly to the building company abroad, they are possibly now insolvent, although we havent had confirmation yet, they dont reply, but this is the speculation by other investors on a forum and in the newspapers. I know that under the consumer credit act you only have to pay a deposit on the card and if the rest is paid by other means you can still be covered up to £30000, however our problem is that a relative paid this from their bank directly to the building company, we have to pay the relative back the money though, it was a loan and we have an agreement in writing. Will this be covered, we can prove that the money went to the same company as the credit card money was forwarded to and also with regard to the same referenced project, will it be classed as same transaction or is the fact that the balance is in someones elses name invalidating?

money!!!

im going to inherit some £110,000 very soon, unfortunately it coincides with me being unemployed with a mortgage of £156,000 !!!! some say plough it direct into your mortgage and reduce it now , others say put it in the bank ? but interest rates are so low it wont make anything for me ,its a quandary , a good one fortunately but advice needed and needed soon thanks

Money Laundering Regulations

Hello everyone, I am in the process of buying a house for cash and my solicitor wishes to see my bank statements showing my funds etc to meet Money Laundering Regulations. Fair enough, I have nothing to hide! But all of my money is in high interest (sic) internet accounts which don't issue statements and I can't wait a week or more for the money to be transferred to my current accounts and for statements to arrive through the post as I must exchange and complete next week. Are there any other mechanisms of verifying my identity and funds for MLR as my solicitor doesn't seem to have a clue? If I can't sort this out I may lose my dream home! :-( Many thanks in advance! 'Johnny Cash'

Natwest Bank Charges! Then in January I recieved a letter a letter stateing I had incured a 28 pound fine. I didnt understand why I recieved the fee, and stupidly didnt do anything about it. Then again in Febuary recieved another letter again stating I had incured a 28 pound fine, so paid 28 pound into account straight away. I did not realise that they were two seperate fees, I thought when they wrote to me in Febuary they were writing to notify me that I still hadnt paid the fee, so like I said I paid the fee and though nothing of it. Again this month recieved another letter, so went into my branch, and a horrible lady at reception explained the how the fees had built up. I paid all the fees at that instant, at a total of 84 pounds. The lady then said I would recieve another fee in April, as I didnt pay my fee in time this month. I asked her why this had all happened in the first place and she said I had gone overdrawn by 6 pounds on the 28th of November. I understand the amount of fees I had was my fault as I should of done something quicker but what makes me really angry, is that when I orginally transfered the 6 pound from my account over the phone, why did the person on the other end of the line let me transfer funds I DID NOT HAVE! I have checked and I only had 1 pound 56 pence in my account so why let me transfer 6? Can someone please advise me on what to do, I would like to get my fees paid back if I could, I'll have paid 112 pound when the next fee is taken. I'm sorry if this post seems stupid, but when it comes to things like this I'm 19 and quite naive. Any help would be really really appreicated. Thank you.

Saving with Ango Irish

I am coming to the end of a 3 month period of off-shore investment of savings in Anglo Irish and am questioning whether it is 'safe' to renew this for another 3 month period in their Fixed Interest Account - particularly given that the bank is now nationalised and people are talking of Ireland possibly going the same way as Iceland!
