The claim was for accidental damage to my TV. The claim has been excepted as valid and as such a claims handling service, BEValued, was appointed on behalf of GreenBee/AXA to proces my claim. They arranged for an engineer from Comet to visit my home to assess the damage and decide upon a course of action. The decision made was to replace the television as the repair was considered uneconomical. Allegedly the claims are processed and the reports may take 72hrs and then a further 24hrs to offer a settlement. Well a week later still no contact had been made so I called them myself. Already riled at this stage for lack of contact, the telephonist told me that the decision was to replace the product with an alternative etc. under the terms of my policy. Whether they would ever have called me is another matter.   I decided to have a look at what they proposed to see if it was suitable. My original TV was a plasma screen from Pioneer model PDP436XDE costing about &amp;pound;2500 and a set of Pioneer speakers about &amp;pound;200 to hear the sound, no integral speakers. Looking at my suggested alternative it is a set from Panasonic TX-P42V10B which I would be obliged to get from Comet, their so-called authorised supplier, and retailing for &amp;pound;1099. To me this does not seem like a fair alternative but I&amp;#39;m told that as Pioneer no longer make TV&amp;#39;s this is considered a fair replacement. Ultimately I would like the same TV but if this is not available I&amp;#39;ll take another Pioneer product and if not the same size at least a larger one, not the smaller one they suggest, or another brand of the same sort of value as my own. It seems a poor excuse on the part of the suppliers to offer me the cheapest product that closely matches my own. Part of the reason for buying the original was for it&amp;#39;s appearance when off and when switched on. To my mind the replacement is ugly and imposing.  How does one go about resolving this dispute? The underwriters AXA say that if I can find my obsolete one somewhere they would have to payout for that. Is it fair to expect them to pay for a different all be it more expensive Pioneer TV if one is available? I made a home insurance claim 2 months ago as i split a vase of water over my tv, dvd player, xbox 360 and original xbox.    The insurance company refused the tv claim as i had it disposed of due to no room to keep it in our house as we live in a tiny one. They refused it due to not being able to inspect it.    I accepted that as it was my mistake. The other items have been inspected by them. This is what they have said.    They are refusing the claim as the dvd player although it had water ingress inside the unit, water marks were present on top. This showed that i didnt wipe away the water and do my best to stop the water. I said i hadnt realised the water had gone that far back as i didnt pull the unit out from under the shelf.    The xbox 360. They have said although water ingress is present on the motherboard the xbox overheated and now has the three red rings and also the microsoft seal is broken. I brought it secondhand so did not know it had been opened. This is a known xbox problem and not caused by water. I stated before to them in my statement that i had continued to play the 360 after the incident as i thought the water didnt cause any damaged and the the three red rings started 3 days after the accident. I was advised by a friend to put in the claim as once water gets on motherboard it corrodes and will cause future problems.    The original xbox was modified by myself several years ago, which included a bigger HDD. They refused this as 4 screws were missing and its been modifed. They said water is present on motherboard which will cause future corrosion. But the HDD is not working due to it not being flashed properly and not because of the water. I stated i had taken the modified chip out so it wouldnt work anyway, but water was present on motherboard which will cause it to corrode and fail to work further down the line.    Any advice on if i can fight this or not would be great.    Sorry its so long. But in the end, it was all settled.  Then, in 2008 a drain in the road outside of our property became blocked (seems a landowner on the other side of the highway filled in a drainage ditch). This caused major road flooding every time it rained, resulting in water being splashed up against the flint wall over a period of several months. During this time, we contacted Norfolk CC Highways team and the landowner, but neither did anything substantial until a section of the wall finally collapsed due to the water damage.  I registered a claim with Brit and they appointed a loss adjuster. This loss adjuster came and did his investigations etc. he then recommended settlement of the claim to Brit. However, someone in Brit&amp;#39;s senior surveying team (who worked on the original tree damage claim) became involved and declined the claim on the basis that it was due to &amp;#39;gradually operating cause&amp;#39; and not &amp;#39;flood damage&amp;#39;. Whilst the damage did occur over a period of several months, I don&amp;#39;t see what else I as a householder could have done to prevent the damage.  Since the wall is listed, I am legally obliged to reinstate (quotes have been &amp;pound;42k) but I don&amp;#39;t have the money to do this. A couple of weeks later we had a heavy rain fall and an this time quite a lot of water came through and wet the lounge floor, I again rang the builder concerned who did come out and look but tried to convince me the problem was not the bay roof but pointing! I also contacted my insurance company at this point as we had another leak in the bathroom ceiling due to cement being washed out from between the ridging tiles, another job the same contrator had done.   Because the ceiling by this time had bowed due to water damage and the builder was taking no reponsibility, I contacted The insurance company, they sent out a builder to check that the ceiling was safe and to stop further water leaking through and a surveyor a few days later. The claim was refused by the insurance as they put it down to wear and tear even though I had proof we had had maintenance work carried out less than 12 months previously.   A week after this, during further heavy rain and thunder storm, the ceiling collapsed under the bay window causing damage to contents. I contacted the insurers again and they have agreed to cover the cost of damage to the contents under accidental damage but not the repair to the building. So far it has cost me &amp;pound;2,000 to get the neccessary work done to repair the damage to the building. Although I am informed that I can make a claim through the court against the builder doing the original work; this will obvioulsy take time and cost me more money and there is no gaurantee I will recover the costs.   Do I have any further claim against the insurance in these circumstances; particularly as they sent a builder out to check and make safe the ceiling a week before it collpased, as I do feel that the extent of the damage that occured could have been prevented if it had been attended to correctly at this time as the ceiling obviously was not safe. I advised them this was a honest mistake (my wife used the esure renewal notice which stated 50% NCD - while applying online to MoreTh&gt;n)  I have tried for the past week to get re-insured and the response is simply from brokers and companys direct - sorry underwriters confirm we cannot insure you!!   I fear that a genuine mistake is going to cost me my house let alone all the car insurance and travek insurance I will need to take out. I am hoping to appeal this decision and have contacted the Financial Ombudsman but surely this has happend to others in the past? Is there a place for people like me to get insurance? I am worried my mortgae will be pulled based on me not having Building insurance. The company stated that the defect was down to poor workmanship.  To explain the history in a nutshell. I purchased my property in May 2008. The house had been renovated before my purchase. In June/July 2009 during the heavy rains, my bay roof leaked and deposited much water in my lounge over a period of a few days. It was evident that the roof was included in the renovation by the new slates and leading.  To cut a long story short, the insurance company assessed it and refused the claim citing the above reason. They stated that I ought to contact the previous owner and ask them to make good the damage.  There had been no history of issues of this problem in the year that I have had this property and I could see the previous owner showing me the middle finger if I approached them. Since then I have arranged for some remedial work in order to get to a time I can get the problem fixed properly.  I really want to know, were the insurance company right in their assessment? Surely most building issues are down to some form of poor workmanship bar the usual factors of time, wear and tear.  Have I gone past a certain date where I can object to their refusal? I do apologise I have left it so late to get advice, but what prompted me today was that work colleague has just had major claim accepted due to her year old en suite water pipes bursting and bringing her ceiling down in her lounge. This was back in June, am I able to cancel the policy by simply stopping the payments? I never signed anything.     Also I have been paying life assurance to the same company since I took out my first mortgage some five years ago, again can I just cancel as I have never had any updates or correspondence with this particular company in five years! they just keep taking the money. We were broken into today while we were out of the house for 3 hours and neglected to set the alarm. Having scoured the policy booklet there is no mention of burglar alarms anywhere except a general reference to them under security advice. However, our schedule does mention a discount for security amongst several others such as staff, neighbourhood watch, promotional, valued customer etc, so I assume we told them we had a burglar alarm at some point. Does anone have experience of this situation. Can they significantly reduce/refuse a claim even when there is no mention of it on the policy booklet? I am a council tenant whose house burnt down, the insurance I have been told have paid out to rebuild.  My query is, do I have any say in the way things are being done, ie; I went in there on saturday to find emulsion being painted over the top of smokey walls, no smoke sealer in sight, emulsion over gloss frames, no rubbing down, I have been told this morning that it is fine to do what they are doing, all electrics being surface run old wiring cut off and left.  I have been told by the council that a new kitchen and bathroom will be put in to their specifications, not replacing what I had done previously. I spent hundreds of pounds on fitting my own kitchen, do they not have to put it back as it was?  My bathroom was fully tiled I have been told that if they cannot salvage mine that they only have to put in new suite and put two rows of white plain tiles along bath, I thought that building insurance covered anything that was not able to be moved ie bathroom kitchen.     I am really stressed at the cowboy antics of the jack of all trades that claims to have pressure tested the pipework, yet my OH is a heating engineer and says they need to heat it up and put it under pressure to check for leaks, the same man doing the pipe work is also the painter who is smoking in my home when told not too. I recently have had to make a claim on my home insurance policy which I have been with for over 20yrs (originally C.U Elite Key Plan which was twice taken over but I was assured under the same terms &amp; conditions,so it&amp;#39;s now Aviva) with only one minor claim over 10yrs ago.  My recent claim is for my daughters bedroom carpet ( a carpet which is matched and fitted throughout the house) she spill t hot leg wax over it (GRRRRRRRRRRR teenage kids).  The Insurance company ( Aviva) sent a specialist cleaning company in from Chemdry but the carpet was deemed ruined.Next they sent in somebody from a company called Independent Inspections Ltd to evaluate the cost of replacement.  My problems are these.  1. I would like to use the original company who fitted the carpet (they still have the original fitter who fitted the carpet working for them).The inspector told me I had to use one of their approved suppliers.  2.When I had the original carpet fitted they removed and replaced the furniture from the room and disposed of the old carpet,the assessor told me I would have to do this,I&amp;#39;m too old for that.  3. The value the assessor puts on the claim using suppliers like Carpetright,B&amp;Q,Carpets4less and other establishments I&amp;#39;d NEVER frequent is about &amp;pound;70 different from the original supplier,who WILL removed and replace the furniture and dispose of the ruined carpet. Can I insist on the original supplier ? I placed an accidental damage claim in June for my 4 year old Kenwood food mixer, which by the way cost me &amp;pound;400. I was told an repairman had to come and take it away for inspection. They did this &amp; told me it will be returned within 7days. I heard nothing so i gave the repair people 2 weeks from the date they took it before ringing them about it. All the guy would say is, i&amp;#39;ve passed the report onto your insurance co. contact them. So i rang Groupama up who said we&amp;#39;ve sent you a letter in the post about it.  A few days letter i received a letter saying we&amp;#39;ve refused your claim on that basis that the cogs on the mixer were well used &amp; worn &amp; that the mixer was well used. I rang them up to argue that of course it was well used, it was 4 years old! The guy who i spoke to was very rude &amp; accusing, he blatantly said i was making false claims.  I&amp;#39;m currently 7months pregnant &amp; throughout the first 5months of my pregnancy i suffered from complications meaning i was too ill to deal with any of this. As i was ill at the time of this phone call, i left it at that for the time being thinking that i will call again. This was in July or August. I rang them again last week and they once again declined the claim &amp; when i asked for my mixer back they said it had been disposed off! I&amp;#39;m so angry with them for getting rid of my perfectly good albiet slightly damaged, food mixer. I was called back by the supervisor &amp; was told yes they should have told me there was a time limit on how long they can hold items but they can&amp;#39;t do anything about it.  Sorry about the long post.
