In August a noise was heard in the car I took it back and was told it was because i was not used to Diesel!! After another 3 weeks of the noise getting worse I took it back again and the wheel bearing had welded to the stub axle costing me over 200 pounds. As soon as the colder weather came the car will not start in the mornings Two weeks ago the clutch went and I had to get towed home 50 miles. I took the car back to the garage and stated that they needed to either repair it free or swop it. They felt that they would not pay for the repairs but would exchange the car. Since this time they are only offering me cars worth 3000 even though I paid 5,000 for the car. Does anyone know what my rights are or what I am entitled too. At this stage - I had never been inside the dealership    Two days ago, I went in and signed a few more forms - we are still waiting for the log book to be delivered on the scrappage car - so not everything is complete.    I&amp;#39;ve just been on the website of the dealership I&amp;#39;ve bought the car from - and they now have the EXACT same Astra for &amp;pound;7999. The price I asked them to get to but they flat refused.  I&amp;#39;ve not got the car yet, and I&amp;#39;m understandly not impressed. Do I have any rights here.    The dealership website says that they price match?  Can they price match themselves?!!?!    I&amp;#39;m prepared to lose my &amp;pound;250 deposit if I have to - but I&amp;#39;m disgusted and want to either:  A) Back out of the deal  b) Get the car on the offer price they are now advertising. Ford has offered me this deal out of the blue and I have been thinking ever since.  I have a 16 month old Fiesta Zetec Climate (3 Door). I bought my car on Passport finance scheme and pay &amp;pound;170 per month. The scheme works in such a way that you pay &amp;pound;170 per month for 34 months and at the end you get a guaranteed future value, which is around &amp;pound;2900. At the end of the term, you can either clear off this and keep the car or refinance the amount, or give the car away to Ford altogether (provided it is in decent condition)  Now, I have already made a payment of 16months and got remaining 18months to pay before I reach the guaranteed future value part.   Ford has recently called and offered me an upgrade to the brand new Fiesta (the new design which has 5 star ratings everywhere). It will be the same Zetec model with Metallic paint, 5 Doors this time and the same 1.25lt engine as my current Fiesta but has more BHP and less engine weight.  The offer is that I hand over the keys to my old car and they give me the new car @ &amp;pound;200 per month, again for the next 34 months with a higher guaranteed future value, which is around &amp;pound;4800.  This deal gives me the newer car which has got good ratings, has extra knee bags, 5 doors, good future value, free bluetooth (don&amp;rsquo;t care much for this), USB port along with standard AUX for music system.  The -ve points are it looks like I have paid these 16 month instalments for just renting the car and will be loosing both time and payments.  So guys, I would like your advise on this. Given a situation like this, what do you do?  Personally, I feel that upgrading my car at this point will be more like a passion for the new one and nothing else. My 3 Door Zetec climate perfectly fits my life-style, but just now and then I keep missing the extra 2 doors!!  Thank in advance.. When looking over the contract their is no where that mentions that the deposit is non-refundable and the only point I can find which mentions anything about the deposit is if the car has been delivered to the forecourt and you cancel. You may loose some of your deposit if they have to sell the car for a lower price.  Where can i go from here or is it a deal loss.  Any help would be much appreciated. I have 2 issues here:-  A) The Kia Dealership are being very unfair on not repairing my vehicle under manufacturers warranty are they not? After all the fault exhibited itself within 2 days of expiry of the warranty.  B) I was told (verbally) that the car had a warranty until September 2011 (5 year warranty) when I bought the car and that he went away and made a phone call to check (probably went to the loo!). I stupidly did not insist on this in writing and they since deny categorically all knowledge of this (spooky!). After a brief inspection in the showroom of the car and a short test drive of the car, I agreed to purchase the vehicle. I was asked to make a deposit of &amp;pound;1,000 and to return a week later with the remaining &amp;pound;12,500 and collect the car. (I was allowed &amp;pound;2,000 tradein for my own car). However before leaving the garage premises, I asked to be shown some of the cars functions (now parked on the forecourt) while the salesman was doing this, I noticed area&amp;#39;s of the car that had clearly been resprayed and an issue with the alighment of a door mirror. The saleman initially denied the car had been repainted, claiming the the "over spray" that I had found was "car polish", he finally agreed that there clearly had been some repainting of the car. I had now totally lost confidance the the car and the honesty of the garage selling the car, so I informed them that I now no longer wished to proceed with it&amp;#39;s purchase. The garage manager now became involved and told me that I had signed a contract agreeing to buy the car and if I did not now do so, then he would be keeping my &amp;pound;1,000 deposit. I then left the garage telling him my solicitor would be in touch, as I didn&amp;#39;t want to waste any more time arguing with him.  I told my solocitor of my experiance and showed him the contract. He advised that as the garage had not sighned the contract (one of the many conditions required in the small text on the reverse of the contract) then it was not vaild.   He wrote to the garage pointing this out and informing them that the saleof the car fell foul of the sale of goods act due to the repainting and demanded the return of my deposit. The garage consequently ignored this letter and so I&amp;#39;ve gone down the route of the small claims court. The garage have said they intend to fight the claim and i am awaiting a court date once their solicitor has submitted their defence.  My question is will a court agree with the garage and not instruct them to return my deposit ? Am I being unreasonable to expect the return of my deposit ? Now obviously having only bought it a week ago for 1900 quid I don&amp;#39;t see why i should be left to foot the bill on this, so I was just wondering if the dealer who sold it me was under any legal obligation to pay for the repairs, get it fixed or give me a refund? Before me and my girlfriend bought the car, we made him put a new MOT on it, but this issue wasn&amp;#39;t apparent or mentioned to us beforehand..... It is stored at the dealership and went to look at it. I found the tiniest chip on it. I know it sounds petty but I want it perfect.  The sales person has tracked down another brand new one from another dealership.   She said she needs a deposit to show some commitment before she trades the chipped one with the other one.   Is it normal practice to want a deposit on a brand new car without seeing it.   She added that if it was faulty, my deposit would be refunded. The sales man was straight in with, well we have a sp ed 1.4 SR7 which would cost less than another one (cant remember the model!!) and you get more for your money. So it would be silly to advise you to get the more expensive one.  He showed me the car blabbled on and on. Anyway I like the car and am very interested in it. I asked about the govt deal and finance. He came back with some figures. &amp;pound;11570 is the cash price &amp;pound;2000 off for deal so &amp;pound;9570 to pay. The finance he offered was over priced so I went away to think about it.    I have now decided to get a loan so I will be able to pay for a car outright.  How much do you think I could haggle, what would be a reasonable amount for the dealer to reduce the "cash price" by? As I have said I have never been in this situation before so would appreciate any advise or tips on making the right choice.
