I received a letter shortly after from the &amp;#39;The Claims Service&amp;#39; basically saying that they understad that I was at fault and that they would be dealing with any claim that comes my way.   I didn&amp;#39;t here anything after that and subsequently received my 2 years no claims bonus when my insurance expired at the end of July. I called budget to query this and they informed me that they had not received a claim against the insurance.  I applied for insurance through Fresh Insurance and advised of my two years no claims and declaired my accident on the 27th May. My insurance cost &amp;pound;400 and I didn&amp;#39;t think anything more about the accident.  I have today received a letter from Johnson Yates Limited acting for Pitney Bowes Ltd advising that they are instructed to claim damages on behalf of their client.  My questions are:  I&amp;#39;m sure I am not personally liable for the damages as this will be covered by my former insurance company?  I had an excess on my former policy, will I now become liable for this?  Will I now lose my no claims and as a result be faced with an increased premium with my new insurers?  Could I claim that the insurers of the other party are negligent as they have taken nearly 5 months to deal with the claim?  Many thanks in advance! And if not, do we each pay our own damages or do we split the overall damage 50:50? Also, having reached a 50:50 settlement, can I opt to pay myself (as my damage is &amp;pound;200 and my excess is &amp;pound;400), rather than through my insurance company as this would avoid higher premiums next year, or would it be too late?  Finally, the man involved works for a vehicle delivery company. I looked at his car after the crash and there did not appear to be much more damage than a bump. I am concerned that, because the insurance is on the behalf of his company, he is just putting in a claim as standard procedure, and may try and blame me for damage that was not actually part of the accident. Driving along the road and a young guy in a big fast car swerved turned into a petrol station and broadsided my car.  Totally his fault. I reckon car needs new bumper, new wing and at least 1 new door.  He already led me to Kwik Fit and paid for a replacement tyre then and there.  He says he will get car fixed whatever it costs and pay for a hire car whilst mine is being fixed.   I am shaky on the legal position this would put me in.  As I see it, the options open to me are  1) Agree to his offer.  I would insist on all paperwork from garage and do my own check for references.  I would also tell my insurers about said incident and explain that he offered to pay.  2) Agree to let him pay for work but at a garage of MY choice, such as a main dealer&amp;#39;s bodyshop and make him leave his credit card number with them rather than me pay and claim back.  They&amp;#39;d probably provide a courtesy car anyway.  3) Tell him to get lost and just phone my insurers and let them deal with it.  I have hire car cover and as it is other party at fault wouldn&amp;#39;t have to worry about being made to cram a family of four into a Micra. I didnt ring my insurnace company because I thought there was no damage. If I ring my insurance company and he doesn&amp;#39;t claim will it go as a claim on my insurance? and if he does ring back when will it be too late to ring my insurance company? Thing is, some fool knocked off my wing mirror earlier in the day ( a day of bad luck!), so when I had the accident I had no left wing mirror.
