In short I was talked into a cash-back deal where I would get &amp;pound;200 which I was told would buy me out of my current contract and signed up to a contract with Orange at &amp;pound;40 per month with an LG Cookie phone.The following day I phoned my current contract provider O2 (through carphone warehouse) who said it would actually cost nearly &amp;pound;600 to buy myself out of my contract! I then phoned Orange (through carphone warehouse) asking if I had a &amp;#39;grace period&amp;#39; if I didn&amp;#39;t want to go ahead with the contract and they said no.I returned to the Carphone Warehouse store and told them that I was assured that the &amp;pound;200 cashback would buy me out of my O2 contract and they said as my O2 was a cashback contract (where I send my 3, 6, and 12 month bills in and get &amp;pound;105 back each time) that this plus the &amp;pound;200 would work out the same as buying myself out of the contract outright.I am now tied into an O2 contract at &amp;pound;35 per month until next June and an Orange contract for 18 months at &amp;pound;40 per month and I cannot seem to get out of either contract. Both companies have said they cannot do anything as I am tied into the contract, but I was sold the Orange contract under false knowledge that the &amp;pound;200 cashback would buy me out of my O2 contract.Where do I stand with this as I cannot afford &amp;pound;85 per month for the 2 contracts? It is also an amount that is too little to chase - it would cost more on their darned 0871 lines just to get eventually a promise that they&amp;#39;ll pay it (and I wonder if it would turn up).  Even sending a letter is not worth it and they&amp;#39;ll ignore e-mails and faxes (although I do not have a fax number and e-mails I have sent before just were never responded to).  There is something about the principle of chasing them that I like.   Has anyone else experienced the same "problem"? Just checked the companies house and there is a note to say that there is a proposal to strike off the mobile outlet. I think if they are in troubles with the authorities, they will not live long and thay may go into liquidation. I tries also to call them and same, no response and recently their phone line is disconnected.  Be warned pepole, do not take any cashback deals. I've e-mailed Dunstone explaining my intention to proceed to the small claims court and I will go down that route.  I know a few people are receiving their cheques back but why are so many not? Why haven't CPW lost their reputation over this? Statements received from the networks today: Vodafone  Vodafone UK has been made aware that the Mobile Media Group (also trading as Cool New Mobile and Phone Box Direct) has gone into administration. Vodafone UK will be working with the distributor, Dextra Solutions, and the administrator to ensure all consumer enquiries are dealt with as a priority.    In the current case, Vodafone UK believes that it has enforceable airtime contracts with these customers. If Vodafone customers have a query about the impact on their airtime contract then they should call 191 from their Vodafone phone.   As this is a recent development, Vodafone UK will be working with the administrator and Dextra Solutions to ensure any impact on the consumer is minimised. Vodafone believes that it has enforceable airtime contracts with these customers and will consider offers to customers on a case by case basis.   As Vodafone UK believes the affected customers have enforceable airtime contracts in place, Vodafone UK does not expect customers to leave before the minimum contract term expires.    General cashback info:  Vodafone UK is following the industry Code of Practice for the sales and marketing of subscriptions to mobile networks recently introduced by the Mobile Broadband Group and supported by Ofcom. We will continue to communicate with our dealers and distributors and remind them of their responsibility to follow the Code. We take our obligations to follow the Code seriously.   We believe that our tariffs are attractive enough not to need further reductions.  There are many other factors to consider such as network quality and services, handsets etc when devising packages for customers. However, Vodafone UK encourages competition in the mobile industry and dealers and distributors are at liberty to devise their own offers to attract customers as long as they do so within the industry Code of Practice. We continue to communicate with our dealers and distributors and remind them of their responsibility to follow the industry Code. We take our obligations to follow the Code seriously.   O2  In general terms, we don&amp;rsquo;t encourage cash back. The majority of our consumer contract business is done directly through our own O2 high Street shops and our online website (o2.co.uk). Where we do such business through a reseller, it is via a handful of trusted partners so the volume of cash back deals is low. That said, there is nothing wrong with cash back in principle. Consumers can and do benefit from these deals.   The problem comes when a cash back deal has complicated or unclear redemption terms.  If we find any reseller offering cash back to connect to O2 where the terms do not follow the operator code, we will contact them to get them to change their terms. We will cease to do business with any reseller unwilling to fall into line with the code.   The operator code (the code of practice for the sales and marketing of subscriptions to mobile networks) can be found on the Ofcom website.  Regarding Phoneboxdirect and Coolnewmobile, we have no direct relationship with either of these companies.  We do, however, have a relationship with a company called Dextra who we believe have done a small amount of business with these companies in the past.  We are not aware of any instances of customers being connected to O2 through either of these companies with an unfulfilled cashback deal.       Orange Orange advises customers affected by the closure of a third party to contact Orange directly. We review each case on an individual basis and will offer the package most suitable to the customer&amp;rsquo;s needs with Orange talk plans starting at &amp;pound;20 per month. As Orange is not party to third party cashback arrangements we cannot accept responsibility for non payment   Orange recently reissued strict terms and conditions on cashbacks and we are working with our dealers to ensure high standards of customer service are met. Any retailer not conforming to our standards will be removed from our roster of distribution partners and will be stopped from selling Orange phones. We have already stopped working with over 100 dealers in the past 12 months who have not met our expected service standards   3 3 has introduced the most stringent cashback terms in the industry in a bid to protect consumers and limit cashback deals   Cashback is an arrangement between the retailer and the customer, and 3 is not liable for any arrangements entered into between the retailer and the customer.  However 3 is concerned by the number of cashback related complaints it continues to receive and has issued stringent minimum business terms which if contravened will result in 3 ceasing to trade with the retailer.   3 will require retailers to submit their cashback offers, and associated marketing and advertising of these offers for approval to 3.   3 has an established process through which all cashback complaints are dealt with.  Customers affected by liquidation will have their complaint examined through this process on a case by case basis.   T-Mobile&amp;middot;          T-Mobile do not feel cashback deals are in the best interest of the customer, the deal is between the customer and the retailer not the network. &amp;middot;          In the cases of dealers closing down, T-Mobile will look at each case on an individual basis. There is usually only a small percent in any difficulty. &amp;middot;          Their policy is not to cancel contracts, they would rather negotiate a cheaper tariff. I asked them how I am going to know it if I havent even received the document stating it. The guy from OSPS then told me that I cant get any more cashbacks.  I was thinking of taking them to court but the mobile deal was actually gifted to me by my uncle and the deals were all in his name. I didnt want to bother him with this. They have a very cleverly organised system, which means that it is almost impossible to get your money from them, even if you stick carefully to the rules. The "original" network bill is demanded, and unless you have proof of delivery, they will claim that it was never received, precluding any chance of further payments. Furthermore, even if you send the items recorded delivery, they often show up as not received......not sure if they have some kind of system with the post where they can get away without signing. By the time the post office will check up on your "undelivered" mail, you are out of the imposed 21 day limit, so your claim is refused. These people are nothing but common crooks. I am going to try the small claims court to see if they can apply some common sense, and if I win, will pay to have the bailiffs sent in, as I know they won&amp;#39;t pay up on a judgement either. In the meantime....DO NOT GET INVOLVED WITH THIS COMPANY! I went through all the forms and clicked i want my cash! 60 days later nothing, yet at no point when you click i want my cash does it tell you then that they are having issues with there database!   Loads of phone calls (one i actually got cut off on purpose - for saying i thought that the company was lying to their customers!) and emails and same repsonse - they say they can not accurately give a date when customers will get there cashback back! Mmmm do you think the Managing Director does not know when they will rectify the problem? "So staff this big system crash, when will it be sorted" "We cant tell you when Mr MD!!" YEAH RIGHT!! Any business will work out errors and problems to see how much it will cost! they should at least give an estimate - they are fobbing us off! The longer money sits in there accounts the better for them!   Another thing is if it was the database that corrupted - you keep back ups! Any decent company would do this to avoid this problem - so the only manual work they would need to do would be from the last good back up of the database to the new!! A weeks worth or month at the most!!   I will not give up on getting my money back!!!! I will use the advise at this website to try and put pressure on them!  Anyone else having problems?? Or advice with mobile Shop?
