I ordered a car to spec from a new car dealer who asked me for a £500 deposit. In the spec I requested a sun roof which was agreed on but the car has just be delivered to the garage and on going to sign some other docs I found out in actual fact it was not an opening sun roof but a panoramic glass roof with an opening viser!! Very disappointed I have asked to pull out of the sale but they are not willing to give me back my £500 as there is a dispute over the roof as they are saying that they never said it would be a fully opening roof. Can anyone give me any advice on where i stand legally and if I can get my money back? Thanks G

Used car problem

Hi, Im hoping someone can give me some advice. My brother paid a £200 deposit on a 2nd hand car to secure it, (even though he had advised the dealer that it failed to go above 60mph on his test drive!?). The dealer had asked for the debit card deposit and ensured him that the problem would be easily sorted out whilst the finance was dealt with (by another dealer in case this matters as this one only offered a year and he could not afford that?). He also claims he was told that the deposit was refundable. I believe that two days later, the finance arrangement was rejected and the dealer said he could only have half the deposit back by a cheque in the post. My brother protested but not knowing his rights he left empty handed, told that he was a time waster and the remainder of the deposit was needed to pay for the car to be re-advertised. Days and phone calls later, still no cheque. A week later a cheque arrived for £125. Should he be happy with this, or is he within his rights for a full refund? I can see hints across the forums that he may be, but really need advice specific to this saga before I get involved. I know £75 is not a lot to some, but he borrowed it from my mum and she really could do with it. Any advice gratefully received....

Sold car on ebay

Hi, I sold my car on ebay on a wednesday, listing said payment within 2 days of auction end, the buyer gave me a cash deposit on the friday and was meant to collect the car and pay the rest the following monday. So I had to go and buy another car as he would be taking my old one. Monday and no-show, Tuesday no-show. Wednesday the buyer said his insurance was not ready but would pay more money, by friday he had paid another amount directly into my bank account and would collect the car within a couple of days and pay the rest. Still no-show. Following monday he emails me saying he is sorry and will pay balance on wednesday or thursday. Wednesday, no money, will not answer his phone. Thursday no money, manage to get through to him and explain that he must pay the balance by the following day as i needed to pay it out. He said he would ring me back in 10 mins. He did not, I text him saying that the money must be paid urgently and that I had been more than lenient (car was sold 3 weeks ago now) no reply, tried calling, no reply. Friday (this morning) tried ringing him at least 20/25 times between 0800 and 1245, sent various texts and an email saying that I would have no option but to assume he no longer wants the car, I urgently needed the outstanding balance, (I had not agreed for him to pay in installments.) I would have no choice but to sell the car to someone else who is willing to pay. Which I did, by 1550 the car was sold and paid for. He telephoned me at 1605 to say he had paid £250 into my account (half the remaining balance) I told him what I had had to do and why, and that I would send the monies that he had paid into my bank account straight back to him. He has messed me about since day one and I have been more than patient. My listing explained that I was having to sell the car due to finances and I had explained the time limit I needed the money by. Which he has ignored completely. Do I have to refund him his original cash deposit too? I only ask because he has messed me about so much without me agreeing to accept payment by installments which would have gone on for over a month...?

BMW Z3 owners?

Are there any Z3 owners on here? He took it to the TT shop in Bedford for some cosmetic work, they noticed the light on, and did a test, it still said Cam prob, they had quick look, and found the belt had been replaced in the wrong position, this annew one was fitted together with the tensioner, and also the water pump was about to fail, 3 weeks later the steering rack failed, but that is another story! We hav been back to the Garage who deny all wrong doing with the fault light, (and the rack ) and that my son should have taken it back....... he did ! They now say that the TT shop were simply saying it was a cambelt fault, and it's nothing to do with Strattons. Although it's weird the light has not come back since the work was 'rectfied' The original garage is not willing to pay anything towards the costs, he was only asking for a contribution! With regards to the steerring rack, the garage said it was 100% when they sold it, and it must have failed in the 4000 miles since where do w e stand pleas eanyone ??

Anyone heard of UK-CAR-DISCOUNT?

Believe they've been trading a while, but can't find any reviews. Recently I've noticed the engine light comes on randomly, sometimes accompanied by a drop in power but not always. It seems to be when the car is cold or the weather is damp, and leaving it running for a few minutes before setting off can sometimes prevent it - but not always. I thought at first that it was the spark plugs but I checked them and they were fine - then I came across this report on the Watchdog site: http://www.bbc.co.uk/blogs/watchdog/2009/01/vauxhall_cars_that_suddenly_lo.html Although this relates to slightly newer, more powerful models it sounds almost exactly like what my car is doing. My question is; have any other Vectra drivers experienced this type of problem and if so, what caused it?

High Mileage Toyota MR2

Hi I have 3200 to spend on a used car. I recieved an email fron the person a few weeks after and asked if i had thought any more on swapping vehicles, As my car hadn't sold i said i would think about it and get back to him - After thinking i decided that i would go ahead and have a look at his vehicle, So we met up yesterday and we both liked each others cars so after much talking and deliberation we decided to go ahead with the swap, WE WERE BOTH SATISIFIED WITH BOTH THE CARS AND BOTH TEST DROVE AND INSPECTED EACH VEHICLE - JOB DONE 2 HAPPY CUSTOMERS!! Or not as the case may be...... Today i recieved a text message from the other person and he told me that his autistic son was petrefied of his now new vehicle and is demanding that we swap back.... I'm a little confused to say the least, should he have not thought about his son prior to going ahead with the swap??? i certainly would have if my son was known to have problems with loud noises - being a Subaru Impreza - They are very well know for a flat 4 engine and a big bore exhaust - Which is what he wanted!! Now i am worried as he is threatening to come to my house and take the vehicle back - Does he have a spare key?! I'm a bit worried. Legally i don't know where i stand as i signed the log book to be the registered keeper and so did he.... There is nothing wrong with either vehicles - Both sound mechanically and bodywork is fine, Both cars are really good but i'm a little annoyed that this person almost forced the swap upon me and now is demanding that we swap back....... Since delivery, the vehicle has been returned under warranty no less than seven times, four of those recovered by Volvo Assist/AA Roadside leaving me stranded. There have been similar problems on each occasion however, on each of these there has been significant, 2-3 days at a time, diagnostic/troubleshooting/guess-work assessment. Almost the entire fuel system has been replaced, they call to say 'we have identified the problem' only for it to breakdown again a few weeks later! The most recent was just last week where the car would not start in the morning. They replaced the ECU and Ignition then flushed the fuel system. Upon its return, the drivers window is now inoperative and will require its return to the main dealer for another days assessment and repair. Does anyone have any experience regarding a vehicle being deemed as unfit for purpose. This car has left me stranded many times, it has seriously damaged my credibility at work as I am often late because it has not started, or has been difficult to start and has robbed me of many days waiting around at various Volvo dealerships. I have lost all faith in its performance and often rely on alternative methods of transport if there is any importance associated with my journey. In the USA I am lead to believe that this car would have been tagged as a lemon already and a replacement offered. I realise that the 'Lemon Law' does not apply in the UK however, surely we have something similar to protect our investment. Many thanks, AA...

Accept replacement? They have excersised their right to repair - with no sucess. it looks like a possible new engine - a fair couple of grand dealer fitted: which of course i would demand it be dealer fitted i paid £6200 before finance for the car so i doubt that would happen [they will be making a loss] so two months later, still the problem occurs, so I CAN EXCERSISE MY RIGHT TO REFUND? After discusions in person with the service manager at CC West Mids i have been informed the next step is replace the vehicle.... - this does not solve the problem.... what if this vehicle has issues? I have a baby on the way, and need a reliable car - well second reliable car, since i am using my partners atm :D If they cannot fix, i dont have to accept a replacement? correct? i would like to exit this agreement now and go elsewhere. A VERY DISSATISFIED CUSTOMER. Thanks!

Had car two weeks..........

Hopefully someone may be able to help here, my ex-partner got another car from a local dealer, she swapped another car and some tree felling for the other vehicle, so no money has changed hands but was a 'barter' contract so to speak. The car she got two weeks ago now has a faulty gearbox and the dealer is refusing to do anything about it. Does she have any recourse.

Blown Head Gasket after having Car 2 months - No warranty

Hi I purchased a used Vauxhall Corsa 04 plate from a dealer on December 16th, this was purchased under a finance agreement for around £3000. Since the purchase I have had 2 minor faults but then came the major one yesterday. The first fault was a windscreen wiper braking, the dealer happily replaced this for me, the 2nd fault was the gear linkage braking, this makes you unable to change gears effectively. I had to call out a Breakdown recovery team for this who advised me at the time this was a common fault and this part had now been modified on newer versions. The other day I noticed I was not getting any heat blowing from my car, I then checked to find there was no water in coolant, at first I thought to myself this was my fault and presumed I just hadn't refilled it again. I filled it up again and the heater was working fine. The next day I checked the coolant again to find the water was gone. All I could presumke then is there was a leak somewhere as water shouldn't have to be refilled so quickly. I then took this down to the dealer who checked it over, after him refilling it a few times and that he hadn't detected a leak that everything was fine and I drove away thinking this had been resolved. about 4 hours later I have been driving the car and heard funny noise from engine so immediately stopped the car to check it and found that water had emptied and loads of smoke coming from engine, it appears there was a leak in the coolant system which the dealer didn't detect. I then tried to re-start the car but it wasn't starting and also lots of smoke coming from bonnet. I went to dealer today to discover that my head gasket was blown, and advised this is costly repair which I would need to pay for there is no manufacturing warranty on the car. To my knowledge this is an expensive repair and after forking 3,000 on a car wouldn't expect this to happen or for me to foot repair bill. All opinions and advise appreciated as to where I stand

buying a car online from CarQuake

Please help I am just about to confirm order for new car to be delivered (I don't fancy going 450 miles to collect it) They won't accept payment over the phone by debit card (allowed ONLY IF I COLLECT) so will I get any protection if I pay by bankers draft or personal cheque. Surely they all need to wake up and smell the coffee and realise that if they want to survive this recession, keep their work force in jobs and sell cars that they need to stop asking for hand outs, reduce their prices andn remember how low the interest rates are at the moment and that we the consumer are not stupid and will not be taking finance at 19 % no matter how many cups of tea were offer

Car Purchase Agreement

Hi, can anyone help, i have recently signed a new car purchase agreement, with my old car in part exchange after carefully looking throught the figures (i know a little late now), and the verbal information provided by the car dealer for my monthly payments, the deal is pretty poor with regard o the apr and also the amount i am borrowing against the car (various extras have now been added). I have not signed the finance agreement as i am ue to sign this when i hand my car over. Can i cancel this car purcahse agreement or re negotiate the various figures on the form without likely penalties as there are no figures (penalties etc), and the form appears very legal
