I wont yet mention the company as i am still in the process of claiming on the other parties insurence.  however i need some advice on how i was dealt with by the negotiator on my car that is written off. my insurer and that of who dealt with looking at the car is all owned by same company or group of companys.  I have a vectra s reg nice condition before someone went in to the back of me at 40mph when i was stationary and also pushed me into the car in front. Now my insurer negotiator said my car was worth £250! when i argues a little and said i just had over £1400 worth of new kit to the engine just 2 months prior he only added £150 to a total of £400 saying that is the max he will go to. I was not happy of this as my personal circumstances means i need a car no matter what. I have no savings and what ever i get from the settlement is all i have! £400 is not going to put me back on the road with a suitable like for like car.   I went away and looked online and talked to a friend of mine. I found out that my car should be worth around £800 going by local adverts for similar car of age and make and model. Cheapest was £450 and highest was £1995. scrap or cars with engine problems were at £350! more than what he said he would give me for mine when it was fully working and good condition. I have since found that the IBA have changed terminology in march on settlement claims so that they reflect and put you back in the financial position as per before the accident because the like for like term was being used wrongly by insurers and being abused and was ambiguous.  The car also just past its MOT, had full service and was running perfect. the reason why it had so much done to the engine was down to halfords monkeys breaking my car everytime it went in. unable to find the cause of it cutting out when slowing down. turns out is was a hose from the body throttle which was cut and they missed 8 times. Instead costing me £600 in parts and not fixing the problem before they messed up big time by putting the fan belt on wrong and it getting wrapped up around alternator when driving and causing a lot of damage to several areas. they replaced and fixed all damage and car was running good after with brand new parts. They also done lots of other tests to make sure the car would not have to come back in as i made several complaints high up. So thats the reason for so much work in the engine. £The £1400 value is what the parts cost them to buy so to have been fitted and done normally it would cost 3k.  anyway does anyone here know of legislative rules they need to ad-hear by when negotiating? i think his offer is shocking. would they be looking to profit out of my miss-fortune? Surely i should not be disadvantaged by someone driving into my car!   My last email to him was that i want £800 or we have a argument over it as i cannot except less. I need a vehicle so that i can pick up my 2 little boys on weekends, without a car i am screwed. So i just cannot let this company work one over me.  any help would be greatly appreciated. i will name them after it is settled as i dont want to bad mouth an entity that may actually at the end do the right thing. But i would like to be prepared as much as possible with ammunition etc in case they argue. I am prepared to fight them on this all the way. I have to! I currently have more than 9 years NCD which is still in place but the Protection has been lifted. Surely this is wrong? It means both of us are being penalised by way of higher premiums. Dear Co-operative Insurance  Reference 0412b12356  On August 28 2012, I called the HomeRescue helpline as the sewer under our house had blocked and there was sewage floating in the back garden. Your customer services contact took some details and then explained that we were not covered. The issue seemed to be two-fold:   that the pipe that ran from the only toilet in the house came down an external wall before descending beneath the house. This therefore apparently fell outside your remit despite your website stating that you covered 'plumbing problems relating to blocked drains, leaking pipes, leaking radiators, water tanks or blocked toilet waste pipes within the home'.   that this was not an emergency because it 'did not constitute a health risk' (your representative's words not mine).  It seemed that your team have decided that it is possible to define the precise location of a problem over the telephone, and the basis of your telephone assessment you determined that the blockage was related to an external pipe. At which time, you deny responsibility and leave the issue back with your (soon to be ex-) customer. You cannot make such judgements reliably on the basis of a telephone assessment, and even if it did involve part of an external section of pipe then reading the advertising text above one would not assume that because a pipe happened to run down an external section of wall rather than an internal you would cover this.  I thought the Co-operative was a mutual which held its members interests at heart. I did not realise that I had become the customer of an organisation that only cared about profits, and put the principle of an agreement (the homerescue contract) beneath the small print and detail.  You left us with a garden full of sewage at 6pm with no help. We have two small children, and no alternative toilet in the house. I assume I do not need to explain the idiocy of the second statement in further detail.  I insisted that a manager call me back which did not happen until the following morning, and in the meantime arranged privately to have the sewer unblocked. When your manager spoke to me, she decided that in fact we were eligible for cover. Something that I would never have known had I not made the effort to complain. This seems to prove the point that it is impossible to accurately judge whether a customer's problem is covered by your policy over the telephone.  Your default should be to offer assistance with the caveat that the charges might need to be met by the customer. Instead your default is to deny responsibility, and thereby guaranteeing that apart from those of us who pursue this issue further, there is no chance you will put your profits at risk.  I am genuinely disappointed that the Co-operative is associated with such practices, although since I have now discovered that you contract this out to Axa (a for-profit company) then at least I understand the source of this mercenary policy. The following year the &amp;#39;Renewal Quote&amp;#39; from LV was extortionate so went back to moneysupermarket and got a quote direct from LV a lot cheaper than the &amp;#39;renewal&amp;#39; so went with that. About a month later got a letter saying there was a problem with something I hadn&amp;#39;t declared. Long story short - after much dancing about seems they got it wrong - it was something to do with my wife (not me) in a her car (not my car) on a different insurance. Got an apology, refund of the extra money I&amp;#39;d paid, problem sorted.  This year got an email quote from Zurich (via moneysupermarket) about 3-4 weeks before my renewal date so nearer the date I checked it out and decided to go with them. Yes you got it - some problem has been flagged up (always after they got our money isn&amp;#39;t that strange?) on the CUE register and it&amp;#39;s something that happened in 2009 but the person involved at Zurich doesn&amp;#39;t seem to know what the details on the CUE are about. First is was a &amp;#39;disallow&amp;#39; but now it seems it&amp;#39;s a &amp;#39;claim&amp;#39; but whatever, it&amp;#39;s against my name. Now I have a letter from LV stating I have 8 years no-claim which anybody would assume means I haven&amp;#39;t had an incident since 2004 (no I haven&amp;#39;t used protected no-claims either) which would mean if you look at it logically then LV are committing fraud (love to see that one in court).   Anyway, Zurich or their underwriting department are now demanding I jump through hoops it seems. They&amp;#39;ve demanded I contact the insurance companies regarding this incident on the CUE register to clear my name which we all know will mean spending time and money sitting for endless hours in telephone queues waiting to speak to a human being and I won&amp;#39;t have a reference number to quote which will just compound the problem. BUT they&amp;#39;ve also asked for copies of my V5 and driving licence which I&amp;#39;ve never been asked for before in my life (which makes me think this is some sort of elaborate scam but I&amp;#39;ve checked the email address and it seems genuine) under threat of cancelling my insurance if I don&amp;#39;t do this within 7 days. To cap it all the email reply from Zurich has been sitting in BT&amp;#39;s spam folder on their server for 7 days.  Now the only thing that have changed since I got my car back in 1999 (those were the days) is my declared annual mileage (different job lot less miles) and of course the fact we are all getting older but the insurance is not getting any cheaper. Some of you may remember me getting in touch last year about BISL trying to bully me into paying them almost &amp;pound;300 for a months insurance after they had:-  A. Hiked up my policy premium by approx 25% after 9 years of no claims.  B. Having not sent me a renewal notification they then renewed the policy automatically as they do.  C. Policy renewal date was April 29th 2011 yet the renewal documents did not arrive before I went to Scotland for a fortnight (May 7th). The "cooling off period" therefore expired whilst I was away and because I had "failed to sign &amp; return the credit agreement within the cooling off" period BISL then wanted to fine me an additional &amp;pound;15!!  Through the helpful people on this forum I then challenged BISL by registered letter after cancelling the direct debit mandate I held with them. Little by little, the &amp;pound;300 or so they claimed I owed them and that they said they would collect via debt collection agency if necessary, was reduced to zero over only a fortnight or so. This resulted in my being interviewed by Flame TV and appearing on the TV show don&amp;#39;t get done get Dom (so what you might rightly say!)  Anyway!  My partner who is also insured through BISL via ibuyeco is now having fun. Back in March she was shunted by another driver into a vehicle at a pelican crossing. Ibuyeco were contacted with all of the necessary details and eventually my partner was contacted via the insurance company asking her to take the car to a motor repairer to be assessed &amp; repaired which eventually it was.  Minster Law also contacted my partner and proceedings began against the driver of the vehicle responsible for the shunt to claim for all costs. This was eventually successful and it was declared that my partner was not at fault for the accident.  BISL appear to take a different view though. Documents for my partners insurance renewal appeared a month ago and indicated a massive price hike desite the blame outcome, my partner, already dissatisfied with BISL&amp;#39;s apparent indifference to the issue of her claim wrote directly to them asking why, in the event of a not at fault verdict being arrived at, had they decided to virtually double her premium? She also told them that she did not want to renew the policy on that basis.  BISL have failed to respond to that letter until today. I believe it was sent over three weeks ago. IF TP has not made a claim by then it will be closed as Non- Fault and PH could ask U/W to recalculate the premium.      IF TP claims and we have an outlay then claim will be closed as fault and premium will remain as it is.     IF ph wants his vehicle repaired under this claim he will have to pay xs and the claim will stay as fault even the TP does not claim as we will be unable to recover our outlay from a minor.     In Mr Kirsopp’s position I would repair the car myself as cheaply as possible – keep the repair documents and IF there is a successful TP claim submit them to us for reimbursement as at that point it would not further prejudice his position.     I hope that the above resolves your complaint"  can anyone with insurance knowledge advise me what to do please. My insurance costs around £12.50 per month and covers £200 of the mortgage (which is roughly half of the monthly payments). It will not pay out in the first month and covers a max of 12 months. I have managed to over pay my mtg by about £4000 in the first two years, so i am thinking that i'd probably be able to get a payment holiday anyway - if not for 12 months then for a considerable time.
