The important word here was 'preliminary'.
I have a feeling the judge who saw you knows that the cases will not be heard until January I would have thought. That is if the cases are heard at all. I would not be surprised if there was some internal pressure for the cases to be derailed, if they can do this. Pure supposition on my part, perhaps I read too many conspiracy theory stories. It is just that I am thinking that if the tide is in favour of the debtors, the people that hold the power must know this and want to keep the water as muddy as possible.

I must admit I skimmed over the word 'preliminary'.
I can't say I'm that fussed about delays - into the New Year at least. This is a small claim (for me - I have MUCH bigger fish frying) and my only real concern would be to clear the DN.
In respect of the DN(s) I don't hold out too much hope for clearing up my credit files since it is clear there is a second (underground) reporting system in use anyway.
It would be nice to get a 142 declaration and a return of interest and fees, but I'm not going to sweat over it, it is just good experience for the 'real thing' (if we ever get there).
These test cases could turn the whole fight upside down though - or make them unnecessary.
