    Re: Hit by uninsured driver

That's right. And 'cannot' is interpreted as the other driver being a. uninsured and b. unlikey to be able to pay. They should take a view on it.

When local scrotes bash your property whilst driving uninsured of course it is theoretically possible to sue them but a reasonable view is that there is little chance of success. So off to the MIB. If this 'business' is a. uninsured and b. unable to meet its debts as they fall due then, likewise, the 'can' of the claim for recovery is very unlikely and a claim might well be met. It is worth making the case.

If they are not pressed then there is little chance of them paying!

Let's be straight here. This a person who did nothing unlawful whose property was seriously damaged by a driver who, it is probable, was knowingly driving whilst uninsured. If the business owning the vehicle is effectively bankrupt / insolvent then it is a matter of 'last resort'.

    Nothing ventured, nothing gained.
