I think you have been wrongly advised. The MIB must cover damage to property caused by uninsured drivers. Your car is your property whether or not insured at the time . . . and given that you were doing nothing unlawful yourself you ought to be protected.
Problem for the other party is thatyou must report the matter to the Police o apprach the MIB! Ithink you should tll them this to add to the pressure . . .
No insurance and 'phone not working suggests a total lackk of money in which case court action could be a waste of time and money . . . I'd suggest giving a very limited time for them to cough up under threat of reporting then report and ask the MIB to expalin their policy of not counting your motor car which was not in use as your property! for damage to which compensation should be due!
As this is a matter of a Government requirement to cover risk to property from uninsured drivers I'd also open communications with your MP and ask him / her to see fair play.
