No there was no overdraft on the account. The account went overdrawn when they added the bank charge. I sent the letter to claim my bank charges back (the one enclosing £10 for copies of all the statements) earlier this year. The total for the last 6 years is arround £400 for this account. I wrote claiming them back and informed them that any interest added onto this account would be claimed back also. They issued me with a letter saying that everything was on hold until the test case in the courts was over.
They have issued me with statements ever since and never once have they been in touch with me regarding this account. My other account with the Halifax runs smoothly and never goes overdrawn. It is only in the last 3 weeks that the calls have started.
I dont see how they can just decide to chase the amount now, after all, they have not been bothered over the last 18 months. The last guy on the phone said they would close the account. I told him to go right ahead and do it. He then replied they couldnt as it was overdrawn. Hsve they started as the account has gone over £50?
So what do I do????? Pay what they are asking and let them close the account and hope for the best if the test case finds in the customers favour or does somebody have a smart letter that will maintain the status quo untill the case is settled. I dont want to end up with a CCJ for something they have done.
I dont have an overdraft so the D/D failed as it would of put me £6 overdrawn but they can add a charge that put me £30 overdrawn!!!!!
