patch:thanks for your advice as i said the £110.00 is at the moment hard but i fully intend to pay my debt nothing i pay is coming of the outstanding balance it seems to be going towards the interest can i ask them to freeze the interest and take my payments of the balance
Patch, you can ask them if they would 'freeze' the interest but they do NOT have to. What they DO have to do is to take your current situation into account. Like I first said, try and work out a 'realistic' figure that you can afford to pay EVERY month, taking into account your income versus your normal living expenditure. 'IF' you are finding £110 a month too difficult to maintain EVERY month then your true comfortable repayment will be something less?
From your original post and claiming that you are at your 'wits end' I would suggest that £110 per month is too steep for you to realistically maintain. 'If' you had to break down your living expenses versus your benefit payments to a court to justify your 'realistic' monthly repayment, that is the way to view the figure.
When you have decided what that figure is, write to M & S (keeping a copy of all of your correspondance) with them. Explain again in detail your current situation and the reasons that you have arrived at the figure that you have. Again, as I have previously mentioned, companies cannot force you to pay what you either haven't got or cannot afford to realistically repay.
