    Yes, that's the trouble with being tempted to buy from foreign suppliers, less chance of successful recompense along with the high probability that fake or inferior counterfeit goods will be sent !

    I am not bothered about the postage I don't want to keep the shoes basically they get put in the bin postage for them will be under £10 anyway.

    To be honest, I would accept their latest 70% part refund offer and keep the shoes as a birthday present for someone you don't like and also save on the postage.

    Otherwise if they refuse to deal with you anymore you may lose the whole lot, a 70% refund is 70% better than nothing%. I would simply email them accepting this offer on condition that they make the refund immediately.

    If you purchased these direct from the supplier in China then the distance selling regs do not apply, even though it's a long distance to China, the DSR are applicable to the UK. In this case snap their hand off and accept the latest offer, at least it will reduce and cut your loss.

    Another possibility, if you have been supplied with counterfeit goods this would place them in breach of contract, this could entitle you to make a chargeback claim through your credit credit or Visa debit card issuer.

    How much did you pay and have you used a credit or Visa card, if so which card have you used?

    This is there latest message 'in usual if is return , refund 60% , last time we mail to tell us 70% for refund we still lost a lot

    pls keep the shoes or deal the shoes , so we can refund u part of payment , i think is good for both of us'

    There based in China and it is a counterfiet product as well, they reckon it'll cost around that to send back I doubt it its not like a brick or anything.

    Send the goods along with a covering letter to this company's returns address by recorded delivery so that you have dated evidence of the return, the letter should be straight to the point explaining that nothing short of a full refund will suffice in order to satisfy and comply with the law under the Distance Selling Regulations.... which are quite clear in regard to your situation.

    Remind them at the base of the letter that unless they make a full refund as they are obliged to do by law, that all yoiur correspondence will be forwarded to the online courts service where you intend to sue them through the courts for the difference. Also remind them they would be faced with the legal costs of any action that you needed to start in order to secure a full refund due to their unreasonable and unlawful handling of your case.

    I note you used a $ symbol in your first post, I am assuming that was just a typo error, otherwise the DSR would not apply to an American supplier?

    There still replying with the same thing only can refund 60% like I'm repeating myself over and over and they don't care that I have right for a full refund. Its getting tiring.

    Ensure that you have written and dated proof that you have first tried everything that was reasonably possible to secure your refund, the courts will need to see this evidence. After that if the supplier foolishly fails to comply with their legal obligations, the rest is as easy as a walk in the park.

    Under the distance selling Regulations; you have a unconditional right to return these particular goods and expect a refund in full, (what you paid even if the delivery was free) providing you have correctly notified them of your desire to invoke the seven day cancellation right.

    You can additionally expect a refund to cover your expense of returning these goods, unless you had prior notification when you entered into the contract... that the return of the goods would only be accepted at your cost.

    Simply inform them that unless they honour the DSR's above and make a refund in full as per their legal obligation, that you intend to initiate legal proceedings through the money claim online service. Remind them that to lose this claim would also cost them the full legal costs.
