So we agree that a debt relief order is not necessarily the one and only solution eastleighjim?
It's also possible, as the problems arise from just one creditor, that an informal arrangement can be made with that creditor. Your local Citizens Advice Bureau may agree to approach the creditor and make enquiries about this on your behalf Mam89.

Yes
Mam89 says she owes £3,000+ which she can't repay. She is therefore insolvent (definition "unable to pay debts as and when they fall due") and needs an insolvency solution. Those are an IVA, Bankruptcy or a DRO.
Any other advice is sheer bunkum

eastleighjim - Tell them you have taken advice and you need a Debt Relief Order. Is that a fact Jim and if so how would you possibly know?
Otherwise I would certainly hope that you're not being irresponsible by encouraging people to tell blatant lies !
It's the telling of lies or refusing to face the truth that gets a lot of people into the troublesome predicaments they sometimes find themselves in.

If you say that you've taken professional legal advice which stated that a debt relief order is suitable, it will be clear that you are being dishonest if you do not meet the criteria.
A debt relief order may or may not be suitable. There are other options for dealing with debt problems but it is not possible to provide a specific solution without more details. Mam89, you need to discuss the situation in detail with an experienced debt adviser at one of the charities mentioned before taking any major steps.

you could contact national debtline who will give you advice straight away and steer you in the right direction sometimes with citizens advice you have to make an appointment

Tell them you have taken advice and you need a Debt Relief Order. Do not get talked into a debt management plan or anything else unsuitable. A DRO is automatic, do not believe that it is up to your creditors or the Court whether you qualify for a DRO.

These are not automatic and they are not something that you can "buy" for £100. However, if you discuss your finances with a debt adviser at your local Citizens Advice Bureau, then it is extremely likely that a solution can be found that does not involve any more unwelcome visits.

Apply for a debt relief order. It costs £100 and you debts are written off. The CAB do them.

Contact Citizens Advice or CCCS. If you have bailiffs coming around to see you, this would suggest that the owner of the debt has obtained CCJ's.

What you will need to do, would depend on whether they have CCJ's. You really need to check your credit records and then to contact Citizens advice or CCCS. You may be able to come to an arrangement to pay a small amount per week or month towards the debts. If you have other debts, there may be debt relief solutions that are available to you.
The legal situation is regard to the catalogue debts, is that you owe these. The fact that you gave the items purchased to your mother in law, makes no difference. They would be seen as gifts, unless you had legal documents drawn up to show that the items were your property and that you only loaned these to your mother in law.

Ultimately, the credit agreements are in your name and you are legally liable to repay that.

If you are quick, you should be able to contact whoever seized the goods and try to obtain possession.
The legal situation is that you were owed money from your mother-in-law's estate (presumably there were no funds there to pay you) and you owe money to the catalogue companies. Catalogue companies often sell at a very high markup to allow for the fact that they often sell to people who will not be able to afford to pay in full.
You can, if you wish, ask that there are no visits or telephone calls. If you cannot afford to pay then you should discuss matters with a debt adviser at your local Citizens Advice Bureau.

Reallly need help ASAP :'(
Hi, i really need help with my debts. I opened catalogues under my name for my mother in law, who was ill in hospital at the time. She didnt have a very good credit rating so i agreed as she was not allowed out of hospital back home until social services deemed the property livable for her to get care, which due to my financial circumstances i had to get these items through the catalogues. Although she agreed to pay them back, she did not pay any of it, and it has amounted to £3000+. Unfortunately she passed away last year because of her illness, and all her debts got written off, however i am left with this debt and i cant pay it. Iv got a part time job, my partner is looking for a job with no luck, and weve got a baby on the way. Can anyone help me figure out if i have to pay the debt off or whether it can be written off as they were opened on her behalf. Also, all the items were seized by her mortgage company with her house when she passed away so we have none of the items that were ordered.
I dont know what to do, im living at my parents house and bailiffs came around and i dont need the stress with being pregnant!
