    Thank you for that.

    It was in 2007 just before the crash, I know they under value now (too cautious to do any other) but over values were very common at that time especially for flats as we have recently discovered.

    Just responding to take it out of unanswered posts.

    This situation I would think would be unusual, as I can't see any reason for overvaluing properties. Normally the complaints are about under valuing properties.

    RICS qualified surveyors do have liability Insurance, so you will end up dealing with the relevant Insurance company. Can't see any quick conclusion to this.

    Surveyor's valuation

    Just wondering if there is anyone out there who has like me had a mortgage valuation by Colley's surveyors. Myself & my partner own 4 properties and they were over valued in 2007 by 35% by Colleys on behalf of the Halifax & TMB. We have just had a retrospective valuation by a well respected RICS valuer which has confirmed our fears. We have written to Colley's who issued one letter which was also their 'Final Response'. Obviously, we know they are not going to admit liability when the total claim is hundreds of thousands. We have also heard on the grapevine recently that the surveyor in question (he valued all 4 of the properties) has been put on garden leave and we know there are many more claims against him. Another issue we have is that Colleys is owned by Halifax (HBOS) who also own TMB so we would class this as a conflict of interest. We are not going to back down on this matter, but would love to hear from anyone who is in the same situation. Please note we don't require advice on this as it is currently being dealt with by our legal adviser, we would be really interested in hearing from anyone in the same situation.
