    Don't quote me on this, I'd still see the CAB as I might be wrong... but I know someone who had this situation recently and a couple of guys refused TUPE. You will be made redundant if you refuse, they've basically come to you with an offer and you will have declined the new terms and therefore said "no thanks". Thanks for all the fish etc!

    Should you refuse, you will hopefully get redundancy out of it via TUPE from said company, if you ask them (your employer) to write you a redundancy letter, and potentially make sure it says nothing about the "voluntary" part things might be easier!

    As soon as you take voluntary you lose loads of benefits such as your mortgage protection, and probably JSA, as you left a job of your own accord. Go see for full employment advice

    It's hard to say where the best available advice could be obtained from with your frustrating problem...however, I would suggest that your local CAB would be a good starting point.

    At least they are clued up on employment rights and where to acquire the information on any points they are uncertain about... they always seem to have a wealth of information and a very good legal backup system particularly on your combination of employment, benefits and housing rights.

    hello, work advice?

    Hello, this probably isn't in the right place, any suggestions were to ask apriciated,even another site.

    Having some work related issues yet unable to get to cab due to work hours. I am writing on my phone so sorry for any formatting/spelling issues, I shall attempt to be brief but I feel I should include everything to get the right advice, so bare with me.

    I work as a cleaner of the landlord areas of a big building (1500 staff big) stairs, comunal areas, carparks etc. I work 50 hours a week and I've been here just gone 5 years, the first 3 years went great, the building was empty and it was just upkeep and managable, 2 years ago a major firm moved in and due to increased foot traffic and the like I was/am working none stop even the managment of my cleaning company said there surprised I get done what I do, and had requested more help,this was refused and dispite my workload going up my pay hasn't in 5 years.

    Then this time last year the onsite management/maintinace company changed and the old guy retired, up until this point I'd never had a single complain from anyone, I've had no more than 2 weeks off sick in 5 years, and I can count on one hand the times I've been a tiny bit late, due to childcare, I was very proud of what ivve done here and that I'm a good employee.

    Sine last year however, and the new management company has come in things have become so frustrating I'm not sure what to do, this company are on there 3rd full time employee in a year, they are awful, example no emergency lighting in a firestairwell for 6 months, allowing said stairs to be blocked with bikes and pallets, but when the tennants or landlords pull them up on it, this are quickly deflected to what what is dirty etc and I get told off, I have tried to make everything spotless but a building this size with so many people I can't do that.

    These deflections have happened 3 times now in the last year, as a result my cleaning company have been asked to dispine me with warnings my company refused they know how hard it is and that I'm doing all I can in the time I have and to top thing off, the new onsite maintinance/manager looks down his nose at me and talks to me like rubbish this has even been highlighted by security, and he's only been here a week, what a good start.

    Now here is the thing, a few days ago I was phoned by a new cleaning company who asked my hours/wage etc andtold me they were budgeting the contract as they were taking it over, I spoke to my boss who said the 3months notice hasn't been given yet, now in my eyes if I transfer to the new company, things will continue and I'll be out after my tupe protection is over, if not sooner, and that's very disheartening because I feel I build a good record here and its going to the dogs.

    However a friend suggested I refuse the tupe ,after looking and please correct me if I'm wrong with any of this if I refused my current company would have to find me hours and pay the same in the local area as I do not drive,so they would have to make me redundant, and as its voulntry and the payment wouldn't be over £1500 I would still be granted cont based jsa, is this correct? Would they also payhousing/tax benifit until I find something else?

    I really dont want to leave but I feel I'm being pushed, and I'd rather leave with my head held high and not let them win,but obviously not if it means no benifits, losing my flat.

    So any advice on where I stand on refusing the tupe how and how the benifits will work in this situation I'd really apriciate it, because I just dunno anymore.
