I bought a Blackberry Torch 9800 on Orange contract from Phones4U in April. My phone has been having faults for the last month, freezing, calls failing, texts not sending or receiving, phone slowed right down etc... Now Phones4U have said that they can only send it off for repair due to it being out of the 28 day return policy. But they said if there is a fault with the phone they can only replace it for the same handset. My problem here is that all I've heard is that Blackberry's having these problems over and over again and friends get the same faults also.
Don't my consumer rights mean that I can have the phone exchanged for another totally different handset within 12 months. How can I go about getting this phone changed for a different make and model as I'm using a phone I can't really use at the moment and all phones4u want to do is send it away for repair!
They also don't take any notice when I bring my consumers rights into it and say I have to stick to their policy and don't take any notice of consumer rights :S
