    We are talking BILLIONS of pounds in EDS case (IT outsource company for the MOD)

    The initial quote was for £3billion - last estimate was £7.1billion - with half the original workforce being made redundant too !!

    I blame them (in part) for the current financial position the country is in.......

    Yes I have come across EDS. They quoted a price for some outsourcing work and when the process was queried they came back with a much higher price. I am sure this was just a misunderstanding of the clients needs, but it did make me think whether they should have been much more enquiring about the clients needs, so that they could quote on the correct basis first time around.

    If the company the OP works for recognises trade union membership, the company may have involved a trade union, once the decision had been made to outsource the work.

    Are you in a trades union ?

    It may be worth joining - even if you don't carry on after it is sorted out - just to get support from the experts .....

    Would the Outsourcing company be EDS/HP by the way ?

    If so - you can take everything that they promise you with a pinch of salt and you will need professional advice.

    Actually I think you might have a case. BUT you are going to have to obtain some legal advice from an employment law specialist. You could try phoning the ACAS helpline to see if they can help you with your query, before you go to the expense of seeing a solicitor.

    My thoughts are that the company were aware that the IT work was in the process of being outsourced and therefore they should have excercised a duty of care to protect staff looking to move department.

    You need advice from someone who deals with employment law and who is aware of legal/tribunal cases that have been brought in similar circumstances.

    What you should not do, is accept the companies word for it that everything is above board and legal. It is worth the effort and maybe some expense in making sure any legal rights you may have are protected.

    I would say "probably not" - since nobody forced you to leave your old position

    What would concern me would be if you had been forced to transfer any pension to the new company

    TUPE regs may not apply to you - as you need to have worked for the company for a certain time for protection

    Sorry but this may have been a mistake - unless the take over company is a good -un (from experience I doubt this.....)

    New job being outsourced - advice pls

    Hi

    I recently moved to a new position within a fairly large company. During the interview and offer of employment process I was not informed that there was a strong possibility that the company would be outsourcing their IT. I now find out, after only 3 months of employment, that my position will be moving to an IT services company, and there is no guarantee my position will be taken on in the new organisation.

    I was just wondering if I have a legal case here? I most certainly would not have moved from a secure position I had held for almost 5 years had I known the situation.

    Any thoughts or questions welcome, and any advice greatly appreciated
