Suggest that you contact Trading Standards and ask them to intervene. They may suggest that you write to the garage first, but they will tell you what to put in the letter.

Sounds like you have come into contact with a rogue trader.

Check your local councils website who you pay your council tax to to see if you can phone the TS people directly. If not call Consumer Direct and they will pass the details to them.

Dealer lying about servicing car - can I get my deposit back?

    Hi all,

I'm after a bit of advice about whether I am entitled to demand my money back. Basically I put a £200 deposit down on a car 2 weeks ago (car costs £3400). This was subject to them investigating and correcting a slight juddering when the car was idle. Following a hell of a lot of backwardsing and forwardsing, the trader has called today to say they have investigated the judder themselves using their mechanic, as well as sending it to a further 2 garages to investigate. He said that all three have concluded that the car is totally fine and the judder is nothing to worry about. Feeling a little suspicious, I found the numbers of the two garages he claimed to have sent the car to and rang them up. I asked them if they had had that make, model and year of car in during the past 2 weeks to investigate a judder; both said that they had not had any of that model car in during that time and had not been contacted by the dealer about it. He has clearly lied about having the car checked over and I am not prepared to buy a car that is not in perfect working order and from a trader that is a liar. I have not let on to him yet that I know he has not had the car checked, but when I asked if I could have the deposit back because I still wasn't happy with the condition of the car, he said I couldn't because there was nothing wrong with it.

Can anyone advise me as to what my rights are and how to proceed with this?

    Many thanks in advance
