    So you are saying that the business manager agreed to hold a car for you, for an unlimited period, while you may or may not get an inheritance.

    Yeah that sounds like good business sense.

    You need a reality check.

    They knew about a month after the deposit was placed as they wanted to sell the car and did so 2 weeks later.

    When did you inform the dealer you would not be able to conclude the deal?

    The fundamental point about this is that the Business Manager told me, although I have no written evidence, that the deposit would be fully refundable should m inheritance not come through on time. There is no way I would have placed a deposit if he had not have stated this. He specifically agreed to this fact but is now saying he never made this statement and herein lies my grouse with the dealer as they are not being honest, telling the truth or being professional. I did sign a contract but for a specific delivery timescale of one month, which obviously never happened.

    All I would like the dealer to say is yes, we did say the deposit is fully refundabel and offer me it back.

    When you placed the deposit, you entered into a legal contract. Are you saying there is no written contract?

    Placing a deposit on a car when you don't have the money to complete, is like buying a lottery ticket and then ordering a yacht!

    The dealership is not going to enter into an open ended contract which doesn't make any business sense. However they should deduct their reasonable costs and expenses, and return to you the change (if there is any).

    That is the fair and equitable result, unless you signed away that right if you signed a contract which specified differently. Look at the paperwork.

    The vehicle was brought in from another branch of the dealership.

    The transaction was dependent on money coming from inheritance, which still hasn't come through. I only put the deposit down and the business manager accepted it only on the basis that if funds didn't materialise, then the deposit would be rufinable.

    Was your agreement a cash transaction or was it dependant on Finance for the balance?

    I put down a 4 figure deposit in late July on a used Porsche at the Porsche centre in Bristol with their business manager. It was very possible that I may not be able to complete the purchase due to a Department of Works and Pensions investigation into my late father's estate so I asked for the deposit only to be made on the basis that it would be fully refundable should the estate not be settled. The business manager agreed to this but there were no witnesses and nothing was put in writing. The Porsche centre is now refusing to return my refundable deposit saying that he never said that it would be fully refundable should my father's estate not be settled. He has gone back on his word and does not tell the truth. What would you suggest I do to make sure they stick to their side of the bargain?
