    Well done bernie,great outcome.I love this sort of thing.as Jason says nicely 'customer/consumer  empowerment'. Trendy phrase but it fits.

    Bernie --- Great news, glad you got the result you deserved, it does go to show that taking them on knowing your rights is always a worthwhile advantage.

    Suppose you will be spending less time watching your PC screen now !       : - )

    Many thanks for your input Conmankiller.

    Got my vouchers yesterday at last. Not quite the value I expected but managed to do a deal with my local Currys shop, although this was not plain sailing. The manager got one of his assistants to help me choose a TV. I chose a TV and stand combination which was considerably more than the value of my vouchers. The assistant did the sums and went away to check with his manager to see if it was OK. The assistant returned and said everything was OK. I made is clear to him that I did not want to pay any extra. When we went over to the till to complete the transaction the assistant noticed that he had made an error in his calculations and that I would indeed have to pay 100 pounds extra. I refused and raised voices could be heard throughout the store (mostly mine). The manager was called and after heated discussions I agreed to split the difference.

    Result.

    Legally they have a "duty of care", for your TV whilst in their possession, and you already have proof they failed this obligation. 

    As Curry's have admitted liability through offering vouchers, then they are obliged to either offer to replace your set, like for like. (or)

    If that's not possible for some reason like it's discontinued and they no longer stock it, then vouchers, or cash equivalent to the price you paid for the set should be offered, in order to enable you to replace it with another set of the equivalent specification and value.

    As for the 6 weeks wait ask them why so long ? If they can't send them faster ask for a loan set in between, I think you may find you get reimbursed a lot quicker !

    Currys Warranty

    I recently has to return my £1400 Sony TV under warranty for a minor repair. When Currys returned the TV, it was noticed by Currys delivery men that it had been completley smashed. Luckily for me it was Currys own delivery men who noticed the breakage when they unwrapped it in my lounge. They took the TV back with a comment that someone would be in touch.

    I have been advised that Currys are going to send me vouchers to the value of the same spec TV. Not sure how they will do this as my old set was a top of the range 36" CRT Flat screen 100Hz Sony Trinitron with extras like picture in picture.

    I feel that because Currys smashed my TV it should not be a warranty issue and that they should re-imberse me with a new 36"+  Sony TV and stand (original stand was dedicated stand for this model). They also say that I must wait 6 weeks?

    Other peoples views would be appreciated.
