    On the rare occasion that I buy clothing items for other people I always ask if the shop will refund in the event they don't fit.

    Thanks very much for the information. They say you learn something new every day. I have learnt not to shop at Spotsdirect.com ever again. I have emailed them to see if they will offer me a refund, if they refuse I will have to either keep the stuff and sell it on ebay or back down and get a useless gift card that I don't want!!

    Retailers are only obliged to offer refund where there has been a breach of the Sale of goods act where a consumer is entitled to 'reject' the goods, anything after that is entirely discretionary dependent upon the policy of that particular store.

    Example, In the case of Argos where they operate a 16 day no quibble return for a full refund, that is operated as a customer relations exercise and goodwill gesture as their own individual policy... because they want to, not because they have to.

    I have never come across this before, not that I buy things and take them back very often! So it doesn't matter if they were bought for my son and he wasn't with me to try them on? Should they display a notice so you are aware of their policy? It does state on the back of the receipt about offering a gift card, but it's a bit late then cause you've already purchased something and stuffed anyway!

    Yes they can refuse to offer a refund in your situation, the Sale of goods act 1979 (as amended) only obliges them to offer a refund if the goods are being returned because they are faulty or not fit for their intended purpose i.e. were of inferior quality or faulty maufacture etc.......not the wrong size.

    Under your circumstances, they are not legally required to offer any refund where the wrong size, style or colour of goods has been purchased and any refund in this case is entirely at their discretion. Otherwise they are well within their rights to only offer you vouchers or a credit note to the same value for redemption in their stores, they will probably quite rightly argue that the goods should have been tried on to see if they fitted before they were purchased.

    Sportsdirect.com - no refunds

    I bought my son some new clothes from a sportsdirect shop yesterday. I have returned the goods this morning as they don't fit. I was advised that they do not give refunds, but was offered a gift card instead. As there was nothing else suitable in the store I declined the offer of a credit note or gift card. All I wanted was a refund. Can they do this? I returned some other goods to a different shop with no problems!
