Re: Tiscali/Roxburghe, Disputed(?) 120£ Payment from 3 years ago!!! (SCAM??)

What a relief to find this thread.

I also have been getting threatening letters from Roxburghe and their pet-solicitors, Graham White, concerning a debt that Pipex told me was settled over 2 and a half years ago. I rang them 3 times but got nowhere.

I am due to see the doctor on Monday as I am dead on my feet. due to being unable to sleep properly. When I try to sleep I just get phrases from the letters and things I am planning to say in court whirring through my head. I have to be absolutely exhausted to be able to drop off.

This is partly due to the appalling treatment I got from Pipex during the original dispute where the cut off my internet for 5 weeks after telling me the only people who could deal with the case had no phone number - and then ignored my letters. I start to quiver with anger slightly even now, when I thin about it.

Thank you Conmankiller, I have sent a copy of the letter you provided to Roxburghe (with the missing word in paragraph 3 added) recorded delivery.

I think I may be able to sleep tonight.

    :)

Found this info online. Suggest that you make a complaint using the companies complaints process. Send a copy by recorded delivery to Roxburghe telling them to stop collection activity as there is no debt owed to Tiscali. Tell Rox that failure to stop collection activity will be reported to Trading Standards via Consumer Direct.

    Hi there

I know you posted this some time ago but I wonder if you had any update?

I have gone through a very similar situation with Tiscali - I left an old address 2 years ago, cancelled my contract, paid in full etc. etc. but then start of this year a company called CARS kept texting and calling re a debt and now, in the last few months Roxburghe are doing the same. All getting increasingly stressful. I am just ignoring all calls / texts as I know how difficult it was 2 years back trying to communicate with the idiots at Tiscali so not looking forward trying to attempting to prove my "innocence" now.

Be really grateful for some advice.

    Thank you

Cheers for that, i feel the letter you are on about could be on its way, but like you say send the letter below back to them recorded delivery. so annoyed about this i knew straight away this was a con because i tripped him up on everything he said , and more to the fact he could not give me proper proof of dates for my so called debt of which i know i do not owe!! would love to speak face to face with these people as don't take to kindly to stuff like this. thanks again

Keep an eye on your credit record with Experian and if you receive any letter from them, send the letter below.

If you read about Roxburgh on various forums, they appear to receive printouts from mobile/phone companies with alleged debts that are highly dubious. They then make phone calls and once they have traced your current address, they will eventually send a letter. I would wait until that happens and reply by recorded delivery.

These debt companies are acting against the OFT's guidelines. They cannot just make phone calls or send letters demanding payments. They have to send proof !!!!!!!

    hi bazza2

i am very intrigued by this forum as i also received a call today 11/3/10 from the same debt collectors stating the same thing. my bill was for £75 when i questioned the caller he stated that this debt was from 2007 !! he then repeatedly told me my old address of which he pronounced wrong each time and then fobbed me off with some rubbish when i told him i hadnt lived their for the time he said and more to the fact my mate owned the house and any letters he would forward to me. also i told him that i do a credit check on experian and this would have highlighted the problem straight away ages ago of which i do regular checks. after a long discussion and lots of dubious answers he hung up on me!!! will this letter you have been told to send help as i do not recall my account as it was a long time ago. cheers for any help.

Re: Tiscali/Roxburghe, Disputed(?) 120£ Payment from 3 years ago!!! (SCAM??)

bazza2 - Should i write to them demanding they prove that the debt is credible?

Yes, you should simply write to them sent by recorded delivery asking them to provide the proof of their allegation, a copy of the prove it letter below will suffice for this purpose.

    Your name address & Date.

    Dear Sir/Madam

Account / ref no. (if known?)

You have contacted me regarding the account with the above reference number, which you claim is owed by myself.

I would point out that I have no knowledge of any such debt being owed to (insert company name).

I am familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

I would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

I would ask that no further contact be made concerning the above account unless you can provide evidence as to my liability for the debt in question.

I await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

I look forward to your reply within 28 days.

    Yours faithfully [print name]

Tiscali/Roxburghe, Disputed(?) 120£ Payment from 3 years ago!!! (SCAM??)

I received a threatening phonecall (and text message today) yesterday from a company called Roxburghe claiming that i owe them 120£ which they claim is my outstanding balance from 3 years ago. At the time when i cancelled my account they informed me over the phone that i had cleared the outstanding balance therefore I forgot all about the company and subsequently opened a broadband account with virgin media (a company im very happy with).

This is the first i have heard anything about an outstanding debt from Tiscali, I phoned Roxburghe today stating that i had no idea about this debt and would like confirmation in writing to which the phone operator told me that ringing tiscali would be useless as they would just refer me back to them...very annoying. When i asked them for information regarding the debt they just said that the debt had been passed onto them for collection. AS you can probably imagine this was quite a suprise to me as ive made every effort in the past to resolve any disputed payments as i endeavour to keep a good credit rating.

Having searched 'tiscali roxburghe' on Google it appears that a lot of people have also had the same problem, i.e. being contacted by roxburghe claiming that they owe money to tiscali from 3 years ago!!

Is this a scam and can they legally demand this money, should i write to them demanding they prove that the debt is credible?

    Regards
