    Some cars now come with fixed glass sunroofs rather than opening. If you didn't specify an opening roof then the dealer hasn't really done anything wrong, although I reckon if you were to tell them you were either rejecting the car or would offer tot ake it and pay £500 less I think they would accept the offer in most cases rather than lose the sale and be stuck with a car in stock.

    It sounds like you have a good case to get the deposit back. The easiest way would be if the garage also agreed.

    If you ordered the car over the phone, you could mention the distance selling regulations. You could also argue that, if they are not going to lose on the transaction, they cannot justify retaining the deposit (I'm sure that they will then deny saying they would make double the amount).

    If they wont agree, you should write stating your case (including mention of their inconsistencies) and stating that you would like to complete the transaction as originally agreed and, if it not possible to come close to that, you will not be taking delivery of the vehicle and you require a full refund of the deposit. If you paid the deposit by credit cards, you could then dispute the transaction through your credit card company. You can also contact ConsumerDirect and, as a last resort, you could give the garage 30 days to refund the deposit otherwise you will use the courts.

    unfortunately they no longer make the sunroof I thought I was buying. It gets a bit complicated, but I was under the impression I was purchasing a sunroof, but they are saying that I was told at the start that this was no longer available. This is where the dispute lays. They have said that they will sell the car and make double the amount on it than we had agreed so this is another reason why i want my deposit back. Also the glass roof was factory fitted so they would not be able to send the car back for a replacement roof. I did try and do a deal with them but they didnt not want to take part in anything i suggested.

    Have you tried asking them to put the roof that you want on the vehicle? I imagine that they would rather do that and complete the sale than argue over the deposit.

    Can I get my deposit back?

    Hi I am new to this and any help would be appreciated.

    I ordered a car to spec from a new car dealer who asked me for a £500 deposit. In the spec I requested a sun roof which was agreed on but the car has just be delivered to the garage and on going to sign some other docs I found out in actual fact it was not an opening sun roof but a panoramic glass roof with an opening viser!! Very disappointed I have asked to pull out of the sale but they are not willing to give me back my £500 as there is a dispute over the roof as they are saying that they never said it would be a fully opening roof. Can anyone give me any advice on where i stand legally and if I can get my money back?
