    My question to Pipex was, "do Tiscali provide your broadband service to me" and the reply was "yes they do",
    i think that is clear enough to a layman like myself, that Pipex employ a third party to supply the broadband service wether it is the connection, the line or the server, given the problems i think it is the server though i could be wrong, i am trying get them to be more specific.
    Payment was by credit card so shall be persueing my credit company to take action for supply of goods and services.

    Sophist:Today I received a letter from Pipex saying I was a heavy user and was outside their Fair Use policy. I checked what this was - it talked about heavy use during peak periods - but didn't say what was FAir Use during peak periods.

    I spoke to Pipex Technical Support and Customer Service - who both said that I needed to reduce my total download usage for the month - not just cut back in peak periods. This makes a nonsense of the "Unlimited" claims for PipexMax.

    I have made a complaint to Trading Standards - I recommend that anyone else who has the same issues does the same.


    Consumer Direct rang me back earlier this week - they have definitely passed my case to Trading Standards as (assuming that I have told the truth) there appears to them to be a definite breach of consumer legislation.

    In simple terms if they say "Unlimited", they have to mean "Unlimited". So if you get the same letter, make a complaint to Consumer Direct.

    They also advised making a similar complaint to OFFCOM (regulator) and OTELO (industry ombudsman) in order to register as a statistic. They don't handle individual issues, but if there are sufficient complaints they will handle it as a sort of "class" complaint (my definition not theirs).

    Sorry to hear of your woes with Pipex - you seem to be one of many.

    I am not sure that I understand about Pipex using Tiscali - unless Tiscali provide Wholesale ADSL lines to other ISPs and Pipex use them instead of BT to provide your broadband.

    For Pipex to terminate your service unilaterally they would be arguing breach of contract through your failure to make payment. If however this was their failure to take payment by direct debit and not yours to make payment, you would not seem to be in breach of contract - instead Pipex might well be in breach of contract themselves by terminating your service without cause. So the crux will be whether your direct debit was valid. Had they previously taken payment by this direct debit and then they stopped taking payment?

    However, I'm afraid that your post is off-topic. This topic relates to Pipex chucking people off - or threatening to - under their so called Fair-Use Policy.

    Please feel free to start your own thread about Pipex and Tiscali though.

    Sorry to but in but i have just had it confirmed that Pipex do use Tiscali as their broadband provider, at least for Barnsley, which is really frustrating as i have left Tiscali 3 months ago for the usual reasons in addtion to them failing to take payment for three months and then they suspended service, due to my supposed failure to pay, it is extremely irksome as i work overseas, so unable to keep
    continuity with contact with the relevant ISP, i shall contacting the tradeing standards office and Ofcom in the regard of missrepresentation by Pipex.

    Thanks, Community. I do understand about the number of pages on the previous thread. Though a little more notice would have been useful - and if you could post a final reply to the old thread pointing people here that would be useful.

    When I get the chance I will copy some of the more pertinent posts from the old thread into this one. Until then, if anyone is interested in Pipex and their Fair Use Policy please post here.

    You are very welcome to continue your discussions on a new thread; the main issue in the other thread was its unwieldy length, rather than its content. Now that the petition discussion has evolved into one about fair use, a new thread is more appropriate, and you may copy and past into new posts any particular points you feel are important.

    The title of your new thread is perfect, as it will lead those involved in the previous discussion, as well as those wishing to discuss the new topic of fair use, to this new discussion.

    Pipex Fair Use Policy (was "URGENT - PIPEX PETITION")

    Thanks to "immo" and "community" for closing a thread which was hosting a seriously active thread about Pipex's Fair Use Policy. Fair enough it had (as immo said) gone off topic (no longer discussing a "pipex petition") but a bit more warning to transfer to another thread would have been nicer.
