    It sounds perfectly legal to me. What is it that they have done that you are unhappy with?

    The bit that is often not done properly is when they change the terms and conditions. Often they will do this simply by telling you rather than by asking you to agree to the change(s). For the details of any contract to be enforceable they must be agreed by both sides.

    Marks and Spencer Credit Card

    Hi has anyone any information regarding the legality of the following: I had a Marks and Spencer points card and used it happily for a number of years to acquire 'points' on purchases at Marks and Spencer stores. The points could be redeemed toward other purchases. A considerable number of years ago Marks and Spencer wrote to me informing me that they were replacing the existing points card with a Marks and Spencer Money Credit Card and the existing points would be transferred over to the new card and I could use it as a credit card and in addition continue to gain points on purchases in store . I was told in writing that I need do nothing and the card would automatically arrive in the post. It duly arrived and I was invited to sign the back and telephone a contact number to say the card had arrived safely. This I did. The pin number arrived safely by separate post later but I was not asked to notify them of it's safe arrival. Currently i read in the press that in applying for a Credit Card, which I did not do in this instance, there are strict guidelines under the Consumer Credit Act 1974 as to the form of the contract and other related matters in regard to the lender and borrower. Can anyone help clarify the legality of this particular procedure in regard to the lender Marks and Spencer.
