    O2 - £1100 Bill off Stolen Phone

    [The Story] ---- While in Majorca I had my mobile on contract to O2 stolen from my room (I think). With me not using the phone I didn't realise it was missing untill near the end of the holiday when I went to use it to call my parants to say I was coming home. Semi sort of panic as I tried to call the phone and it was turned off, after a complete search I concluded the phone was gone.With the phone being off I figured (wrongly) that if it was gone the sim was pulled and the phone sold on. On my return I rang to cancel the phone and he told me £950 of calls had been made on the phone, after checking today it was £1100.

    [Advice here] ---- £1100 of calls made to my O2 sim after phone being stolen. What routes can I take, if I cancel the direct debit and let them take me to court what can I expect? They say they cannot do anything, would a sort of compromise be possible say if I pay half as a good will gesture? Would I have anything to stand in if they do take me to court or would I be just shafted?

    On a sob story £1100 is more than a months salary which I cannot afford, I would have to get a loan to pay this off.

    Rob-Hull:

    You need to check a couple of things. Under your O2 contract, what are the contract terms about reporting a stolen phone and your liability for consequential loss ie. phone calls made since.

    Does your O2 contract include Insurance to cover the phone and associated losses. If so what does the insurance contract state about your responsibilities to report the phone as being stolen, to minimise loss.

    Once you have had a good read of ALL information, post back with the details.

    I am sure there is a set procedure for these situations and therefore you should not rush to judgement that you will owe £1100, without a FULL investigation of all aspects.

    In the meantime you should continue with the normal monthly payments to O2 and follow their complaints process if you have a problem, including reference to Otelo. I think you will have to pay something, but not the full £1100. I believe there are precedents, where telecoms companies have only been able to make reasonable charges.

    Just an update for if anyone finds this page in a similar situation. I finally got this sorted by the point that the numbers called after the time I disputed it had never previously been called on that phone. I should receive a credit for the full amount disputed which ended up being £1825.
