Suggest that you ask your bank to refund your account as the payment was not authorised by you.

Then advise the housing company that you have done this. If they want to charge this amount, they will have to confirm this is a new contract with you.

If they were allowed to get away with this, they could just randomly debit your account for whatever purpose. You could have gone overdrawn and incurred charges.

Yes, go and get your money. If they won't speak to your bank.

Nb. And ask them to remove your bank details, as they do not have your permission to continue to hold these.

I have a copy of the contract in hand fortunately. Funnily enough, from first inspection there is no mention of an admin fee whatsoever. So i am within my right to get this back?

They cannot claim the admin fee again if this is not written into your contract. You should ask them to supply a copy of the contract noting this rolling charge. If it is not noted, ask for it back.

If they refuse speak to your bank about this. If the amount was unathorised the bank can refund your account and send this entry back to the housing company concerned. Is this a direct debit transanction? If yes, you have a DD guarantee that they have to comply with, otherwise the bank have to refund you. If it was by switch/debit card , again if you did not authorise, your bank has to refund.

    1) Speak to housing company about contract/authorisation. Then if not resolved

    2) Speak to your bank and ask them to refund your account for this unathorised amount.

Admin Fee's on a rolling contract

I'm a student letting of a housing company.

Here's the deal, last year, i handed over all the details such as bank account etc on my previous contract which ended 17th of this month. I signed a new contract in Feburary, which started 18th of this month. I got charged the bond, then an admin fee - even though it states this is just because they have security checks - £35 for that? Don't be daft.

Regardless of that, i never resubmitted to them any other information this year, they just kept my same bank account details on system without permission, and have already charged me - is this right?

I just don't see any justification in being charged £35 when they already have my information on file, let alone using this information without my consent - add to the fact it was a rolling contract - therefore same details, and they have proved this by already charging me.

Am i within my right to claim this admin fee back from them? I was going to use this account aswell, but they don't no that - good job i have an overdraft to cover the £377 that come out without consent - if not, i would of been charged by the bank then the company.

    Cheers, DarrylJ.
