    I'm currently working through the labourious complaints procedure - letters going off to Otelo, thieir Ombudsman, and to Oftel today.

    Thanks for the adivice though - hadn't thought of it in terms of the credit agreement.I shall be following that up.

    Hi there,

    I'm pretty sure one of the previous responses to this was to find out the complaints procedure and follow it through.

    Also consider finding out who the chief exec is and writing the complaint direct to him.

    You should be pushing for them to honour the stated price plan for the whole term.

    Alternatively you may be able to get them to reduce the plan cost.

    You could have a look at what tariffs are available from Vodafone that are comparable for new customers, and think that a loyalty of £5 a month difference would be an acceptable price.

    Have a search of the forums to see what advice / contact details have been given to sort them out.

    As always try to remain clam, assertive and polite.

    If the contract does not exist, how can you be charged for an indeterminate service plan (tariff)?

    As it is a credit agreement / contract, you may be able to request this under the CCA.

    If there is no contract, then what terms are in place to keep you locked into your phone? You should be able to leave them and go to someone else.

    Mobile contract over the phone

    I understand that a verbal contract is binding, but what if the lovely sales person "forgets" to tell you all of the T&C - like that the reduced tarif they are offering is in fact a "discount" and that it will only last for 9 of the 18months of the contract? My partner and I have both been stung by this and from reading through the formus, so have other people.

    Is it legal? I have requested the recording of the call where the new contract was agreed to prove I was not told but Vodafone say that these are destroyed after being used for training. I have also requested a paper copy of my contract as I was never sent one, but have been told that this too does not exist.

    I am not impressed at having to pay double the monthly cost I was expecting for the remainder of the contract. Any advice as my stack of letters over the last few weeks have proved unsucessful.
