    can i get out of my contract early

    I have been with virgin now for about 8 months and the service has been terible. I can only connect about 60% of the time and that is usually in the night and then i can only get about 100kbps download and 300kbps upload which does not make sence to me because i thought download was higher than upload. The customer services do not help i've contacted them loads of times and now i just want out! thanks.

    Minimum contract period is 12 months. However, if Virgin have not provided a service as detailed in your contract terms, you may be entitled to cancel prior to this, but this would be difficult as Virgin are not that easy to deal with. Contact Consumer Direct for advice but make sure you have details of your contract as well as records of the service you have experienced. There is a broadbandspeedchecker site. My Virgin broadband shows download av speed of 9360kbps and 460kbps upload, and it is 95% est reliable. It does slow down or grind to halt on occasions.

    The speed of connection can vary quite alot, depending on where you live, proximaty to exchange, number of houses connected to exchange etc. Having said that I was getting faster speeds on dial up, than you are experiencing, so there must be a problem. Should Virgin have sold you a service? I have heard that Virgin have installed Broadband to properties in some areas, where the connections are not ideal and need to be upgraded.

    Ok thank you huckster ill try them. I did get 900kbps on monday for about 2 hours and thats the highest i've ever got. Do you know if there is a minimum speed that they are supposed to supply thanks

    What you will find is that Virgin will use their terms and conditions in their favour. This will be along the lines of, the speed of service will depend on a number of factors e.g. volume of users. Your best bet is to record you speed at different times over a period of a few weeks, take advice from consumer direct and then complain to Virgin with the details, advising that you will terminate the service within x no.of day, unless Virgin can improve the service to the level advertised. On the advert for your service there would have been mention of the average speed you would expect to receive.
