    Thanks for clearing that up i will definatly do that. I do have a savings account with alot in, however i didnt have an overdraft as every month i have been left with alot in my account and so never needed one. however this month i had more expenses then normal and i became complaicent with my account and didnt check as im so sued to having money in there! i however was mistaken and was overdrawn after 7 small transactions of £50 i was charged £28 for using an unauthorisaed overdraft! Which seems ridiculous. Im more angry because i have money i could of easily transferred over has i realised, and 7 transactions later and almost a week later i am now left with £270 fine. But anyway i will do what you have advised and will take the charges further. So thank you

    Sorry Citizen's Advice Bureax (forgotten how to spell). Do the minimum not to fall foul of your bank, whatever that is. Also the Financial Service's Authority has a consumer advice section, Give them a ring BUT if you think the CAB can help get on to them straight away because it normally takes maybe a week plus to get a specialist appointment.

    You seem to understand about the charges court case so not much to add there. You are entitled to register a complaint but it won't be processed until the legal action is exhausted.

    Several specific pieces of advice for you.

    (1) Don't move your pay. The reason for that is that overdrafts are repayable on demand and if you stop funding the account the bank will recall the overdraft.

    (2) Open a basic bank account at another bank.

    (3) Transfer your spending money every month to the basic bank account leaving enough to fund your main account.

    (4) Lock away your main account debit card and withdraw cash using only the basic account card.

    Meanwhile read the terms and conditions for your main account so that you understand exactly what is hapenning.

    Regarding not paying the fines, unfortunately you can't do that. You do not get sent a bill to avoid paying, the fines are charged to the account.

    BTW you mentioned a savings account. I'm assuming there is nothing in it otherwise you would just have paid off the overdraft but if there is be aware that under "set-off" the bank under certain circumstances can dip into it. You mentioned a credit card. If you have available credit maybe you should pay-off the overdraft. The bank has already refused to refund the charges so your only hope now is to wait for the charges case to be decided. Paying off the overdraft won't affect any rights to a refund of charges - but will undoubtedly reduce the risk of more charges.

    So do you think i should just pay the £270 fine, and then take it to the financial ombundsmen? And sorry what is CAB? If i dont pay into my account this month all i will get charged is intrest which will probably be a couple of pound? By standing my ground will i not have more of a chance of getting it removed as appose to them maybe one day having to pay me back?

    No, no, no!!! Don't do anything that is not strictly in accord with your bank's wishes OVER THE IMMEDIATE FUTURE. Don't move anything!!! UNLESS you want to risk wrecking your credit rating for possibly a long time to come.

    In the cool light of day sort out exactly what your situation is and if you feel you would benefit from advice, decide what advice you need and perhaps get on to your local CAB.

    No overdraft - now in £270 debt for £50 do i have to pay??

    I was not keeping track of my money and unfortunatly i spend money on my card that i didnt have. However as i didnt have an overdraft i didnt think i could spend money if it wasnt there!! So for the past week i have been spending money on my card not realising that i was in debt. This all began on Saturday when i went overdrawn by £2, i received a letter on thusday telling my i have incurred a £35 fine and £28 penaltiy for going into an unauthorised overdraft. I have added up that during the week my total cost is around £270!! This was obviously a total shock to me as i didnt even know this could happen! I then rang the bank and complained about the charges, they have refused to take them of, i then spoke to the complaints department who once again refused however they did give me an overdraft of £250 to cover the banks charges.

    My plan now is to open up a different bank account and get paid into there, move all my direct debits and not pay the fines. So for the next year i will be in debt to the bank-however it isnt money i have spent it is money that the have obsurdly charged me for being £50 overdrawn. I have wrote a letter of complaint to the bank and i await there response. The woman i spoke to from the bank today said that she will send me a letter with regards to the financial ombudsman to take my claim further.

    So as i have this overdraft for a year, and claims are currently on hold due to the courts not reaching a decision do you think it would be a wise idea to not pay the overdraft, close all other accounts with the bank (i have a small business account, savings and credit card) write to them every month informing them of the unfair charges and if in 10 months time they still have not give in i pay the overdraft but then go through the small claims court to get it back??

    Any advise would be much appreciated.
