    Once the original period expired, unless you or your landlord have given each other notice that you do not wish it to continue it becomes a "Statutory Periodic Tenancy". Two months notice is required from the landlord, but only one months notice from you.

    To end a Shorthold tenancy the landlord must give at least two months' notice under Section 21 of the 1988 Housing Act.

    Once the fixed-term has ended the tenancy automatically becomes a periodic one. Here, the landlord is required to give 2 months' notice, and the tenant gives one months' notice in writing (when rent is paid monthly) or 4 weeks' notice (28 days) when the rent is paid weekly.

    The AST examples I have seen have a commencement date and the document then defines the tenancy period, but I cannot see expiry date. I am presuming that when you agreed to continue the tenancy, beyond the original period, you have extended the original agreement. Did you sign any documents when you extended the tenancy and if so did you keep a copy of these?

    You should seek advice from your local CAB office and then approach the letting agent. If you have not signed any documents to continue the AST beyond the initial tenancy period, can they invoke the terms of the original agreement?

    In regard to you not paying the 2 months even if you find that the agents have made a mistake, will this cause you a problem renting another property? Is there a blacklist?

    Assured Shorthold Tenancy Agreement

    I had an AST which expired in November 2007, I have not had another tenancy agreement since. Now I have decided I want to leave the property (found nicer one in better location), the Lettings agents are saying I have to give 2 months notice (this was in the AST that expired in Nov 2007) but I have not had an agreement since it expired. Can they hold me to two months even though I now dont have an AST with them? Help pls!
