    Well tax credits and taxes are treated complelety differently, so the overpayment will be recovered and the underpayment from the BR code will be repaid to her, this is pending she has no tax that might owed from any other years first.

    does she still received child or working tax credit? if so then you may find that they are already collecting the amount she owes tax credits through her current payments.

    its not my job to apolgise for the state of the post status with the tax office, but i can offer an explaination. a new computer system was introduced in june, meaning the old one had to shut down and the records needed to be transferred across to the new one, this meant the post (which was already 2/3 weeks behind) then built up, leading to a larger backlog.

    You can phone the appropriate HMRC department and speak on an anonymous basis for information and their website is helpful.

    HM Revenue & Customs overpaid tax

    Hoping somone here can give some advice. My mother in year 2005/2006 was overpaid on her Child tax, and Working tax credits (recieved more than she should have).

    Recently she hadn't spotted she was working on the basic rate and therefore applied for a tax refund for the past year or so with her office. The HM&RC office has taken almost 3+ months now to say they will open the post in 5-6 weeks.

    The concern is a letter has just come through about the 2005/06 overpayment and £750 is due, are they able to take this from her tax refund?

    Also, considering it is their own mistake she was overpaid this amount, it hardly seems fair to take this money back?

    Please advise?
