Claiming back on credit card guarantee.

    Claiming back on credit card guarantee.

    My fiancee purchased her wedding dress from a store at a wedding show, half was paid through her maestro card and the other half was paid by her sister on her credit card.

    The company then closed down without paying the designer for the dress, with almost no hope of claiming the money back through the shop.

    Could any or all of the money be claimed back through the cradit card, or by any other means.

    The total spent was near £1400.

    Under s75 of the consumer credit act 1974 it is only the original purchaser of the goods who enters into the contract, where the purchased goods total amount has to cost between £100 & £30,000 to qualify, therefore only the person who uses a credit card and is the purchaser can make the claim that a contract has been broken by the supplier... entering bankruptcy or failing to deliver the goods.

    This would mean that your fiancee would not be entitled to claim because she has used her Maestro card to pay for the dress which formed the contract.

    If on the other hand it had been your fiancee's Sister who was the person getting married and she had bought the dress using her credit card, then the contract would have been hers. In that scenario, she would at least have been able to claim her half back and possibly the amount she borrowed off your fiancee's Maestro card, under those hypothetical circumstances.
