    need help

    Hi,

    I have received a letter from Police with intention of prosecution. In the letter they have listed three points

    1. not stopping after collision

    2. Failing to report after collision

    3. Driving vehicle in inappropriate manner

    It was driven by wife on the day mentioned in the letter. I have examined my car and I could not find any sign of collision. My wife was driving with a passenger and they don't recall anything like that happened on that day. They were also in the store (they have receipts) at the time mentioned in the letter.

    I am going to fill the form they have sent me telling them that my wife was driving on that day. Should I also mention that I could not find any sign of collision on the car? Has anyone came across such a situation and how does these matter proceeds.

    I would advise finding out the name/number/station of the police officer and giving them a phone call. Visit the station if nearby with the information you have, advising your wife was shopping at the time of the alledged offense. The police would rather sort this out without going to court to avoid unecessary costs. They might have evidence from a traffic camera which may show who was driving. Did someone else have access to the car keys at the time?

    Many years ago the Police tried to add another offence to a speeding offence. I phoned the officer concerned and politely told him I would speak to his Inspector about his lack of following correct procedure. He soon backed down.

    My advice is always challenge any authority if you have any evidence to support your case. Most would rather sort any issue before being embarrased in any court proceeding.

    Just an update, I provided police with the evidence that my car was not at the place/time of the incident. I have now received a letter that they have closed the case and no further action will be taken. This whole thing caused mental stress and I am not happy with the other party who made false allegation. Is there anything legally I can do?
