    You should just go into the dealership with your letter and ask for the money. Do not leave until you have it in your hand. Threaten to call trading standards unless, they pay it. Put the trading standards number in your mobile, ready to make the call if you have to.

    Moving on from my first post on this topic about a month ago, i have got my vehicle docs back from the dealership, along with a covering letter which states"With regards to your deposit we are happy to give you the refund but have been unscuessful in contacting you. Please contact myself so we can arrange for the deposit to be refunded".

    I have made numerous calls to the dealership with regards to this letter, and all my call went unanswered, they are now also not responding to my letters.

    Does anyone have any advise?

    Thats actually not necessarily always the case... I would read the ts and cs on the back of the order form...

    Have you both signed the order form? if not then the agreement is not binding then you can get your money back without question.

    If you have signed it and no where in the agreement does it say that can retain your deposit.... you are entitled to it back... unless costs have been occurred in which case they need to prove it.

    Hi - If a deal which was dependent on finance being accepted through the dealership does not proceed for any reason, then the, "three party" deal is not concluded or legally binding on any of the parties.

    In this case (ask) the dealers must return the deposit on hold and return the documents leaving you in the same position as before. If they try to be difficult or refuse... then see your local trading standards dept.

    Had the deal been a cash agreement only, then this garage would have been entitled to keep some of your deposit to cover any reasonable out of pocket expenses they had incurred.

    Car Finance Rejected - Deposit back?

    Hi Guys,

    I went ahead to buy a car, and got refused finance, and paid a £500 deposit, and left my current vehicles registration document and MOT certificate with them.

    The dealership ordered the car before the finance was arranged, and has now sent me the vehicle confirmation of registration details.

    As they were due to arrange finance, which is showing on my order form in a box stating "balance due from customer" as nil, can i get my documents and deposit back?

    To top it off, i requested a car to be a 59 plate for delivery in september (which is on my order form), but this is a 09 plate due for delivery in 7 days!

    Any advice on what my rights are, and where to go from here?
