    The sale of goods act 1979 (as amended) only allows Six months maximum, after the sale of the product in which the retailer is deemed to be responsible for the goods they have supplied.. or to be fit for the intended purpose they were purchased, or otherwise free from defects..... So you've timed out with Play.com. !

    After this period the manufacture should stand by their warranty and rectify any manufacturing defects free of charge. If you possibly can, get the man in the Nokia repair centre to confirm his opinion in writing and send this along with a letter of complaint from yourself outlining your concerns - to Nokia customer services...asking them to stand by their warranty not only as a matter of honour, but as a good customer relations exercise and out of goodwill.

    Phone bought from Play.com

    I bought at Nokia 6600 fold from Play.com in October 2008, using my M&S credit card. The phone was £229.

    The navigation key on the phone has split and has then developed another tiny split. I contacted Play.com and they advised me that the phone was only under their warranty for 28 days and that I would have to contact Nokia. After contacting Nokia they advised me to take it to one of their approved repair centres (nearest store 30 miles away). I therefore took my phone into the Carphone Warehouse, where there is an Nokia Repair Centre. I was advised that the phone was not covered under warranty as this was not a common fault (and not listed in a Nokia 'bulletin') so therefore I would have to pay £45 to have it fixed. I contacted Nokia as I was somewhat surprised with this decision. I have not damaged my phone or mis-used it in any way. Nokia advised that I could take it to another repair centre (another 30 miles away) for a second opinon but their technican's decision was final.

    I took my phone into a local repair centre to see if they could give me a quote on repairing the navigation key. The man was very surprised that this was not covered under Nokia warranty as he could clearly see that it was a defect and that the phone has not been damaged in any way. He suggested that I contact Nokia again.

    I contacted Consumer Direct, but because Play.com are based in Jersey they are unable to help me as it comes under Jersery Trading Standards. I have contacted them and was advised to contact Play.com again as they are the seller.

    I was advised that it would be their argument against mine as to miss-use of the phone and is it worth going through all the procedures when I can get it repaired for the sake of £45? I personally think that the phone should have lasted more than 8 months and the key should not of split and is not really a question of the money.

    What is the best line for me to take? I would be grateful of any advice.
